Officer for said election in Ward No 5. tor whic
Mr. Sinith was one of the Candidates, that the

Officer autil alafe hour. His Worship the Mayor
then explained to the DBoord that it was the duty
of Councillor Brown to have acted as Returning
Officer at that election, he being Councillor toi
Ward No.5
His Worship also said that he caused the City
Clerk to com with Mr. Brown the
subject, ar d read that gentleaan's reply to the
Board, declining to act as Returning officer os the
occasion referred te, as he, (Mr. Brown) deelined
te serve any longer as Councillor tor Ward 5
His W CT added that Mr. Brown should tave
performed his official duties antil he had complicd
with tae terms of the law relative to his position
neaftructions to act
nulicate on
as Councillor, hence the cause of the delay relative
to the opening of the Poilat the-hour of 9 o'clock
as specified by law. The Bourd then proceeded
te hear evidence relative to the protestin question,
with the view otf ascertaining what vetes (if any)
were lost to the contending Candidate, Mr. Smith
becau-¢ of the late hour at which the pell was
witnesses were, called bat it
the evidence eould be produced

appeared that
tu show that electors had been deprived of the op-

at whieh the poll wasapened, Several wienbers
of the Board then expressed the opinion that ae it
shown that voters were precluded
frou) recording their votes at aaid election, be-
cuuse the poll had hol been opened at the honraetf
9 o'clock, as prescribed by law, Mr. Hooper's

votes, should be coufi med
Phere being a difference of opinion, however,
on the point before the Board, it was deemed ad
weof the Reeorder te obtain
Hien on the subieet, and his Worebip,
in compliance with the request of the Board,
proeured in writing the opinion of eounael, which
only served to substantiate the views of a majority
af the Board as expressed in a Resolation «ul-
mitted by Couneillor A. H. Yates, to the effect
that the pretest of Mr. H. B. Sunith, agaiast toe
validity of the Election held on Saturday, the 20th
of July, tor Ward 4, was stifficrent
validate said election, nw evidence having
heen addueed to prove that any veters in the said
Ward bad beeu precluded from polling a vote fo
either of the candidates d iring the day ; and that
therefore the election of Mr. D. M. Hooper he
coufirmed. Cottneitler Morris submitted an
dmendment, to the effeet that the Board having
heard the protest made by Mr. Sanrth, and alse
the Presiding officer's admissson relative to the
hour at winch the Poli fur the Election jn question
was opened, cannot but consider that the said
Election was net opened as required by the I2th

that the Poll for said neat
opened according to law at the hour of nineo' clock,

Councillor Breckes admitted, as Returning
Officer for said election in Ward No 5. tor whic
Mr. Sinith was one of the Candidates, that the

i the eapacity of Returatag

Hooper's
i# Councillor, he baving @ majority of
votes, should be coufi med
Phere being a difference of opinion, however,
on the point before the Board, it was deemed ad
weof the Reeorder te obtain
Hien on the subieet, and his Worebip,
in compliance with the request of the Board,
proeured in writing the opinion of eounael, which
only served to substantiate the views of a majority
af the Board as expressed in a Resolation «ul-
mitted by Couneillor A. H. Yates, to the effect
that the pretest of Mr. H. B. Sunith, agaiast toe
validity of the Election held on Saturday, the 20th
of July, tor Ward 4, was stifficrent
validate said election, nw evidence having
heen addueed to prove that any veters in the said
Ward bad beeu precluded from polling a vote fo
either of the candidates d iring the day ; and that
therefore the election of Mr. D. M. Hooper he
coufirmed. Cottneitler Morris submitted an
dmendment, to the effeet that the Board having
heard the protest made by Mr. Sanrth, and alse
the Presiding officer's admissson relative to the
hour at winch the Poli fur the Election jn question
was opened, cannot but consider that the said
Election was net opened as required by the I2th
