Great Britain proclaimed a “danger area" in the North Sea early in Octo- ber, and at about the same time France announced a “danger zone" in the Adriatic. The British and French areas were mined. They were de- clared in response to the alleged pre- vious laying of mines by their oppo- nents. Such areas are more properly called “danger zones," as is evident from the statements of the Chinese delegates to the second Hague con- ference ln 1907 that 600 Chinese small boats had been sunk by mines, and with considerable loss of life in the area of the Russo-Japanese mlne-lay- ing activities. China was then neu- tral. No protest seems to have gone further than the British contention that “no international usage sanc- tions the employment by one belli- gerent of mines or other secret con- trivances which would without notice render dangerous the navigation of the high seas.” Since that time it has generally been recognized that a "war zone" or a “strategic area,” or a “danger zone" or other similar area, must be within the effective control of the belligerent maintaining it. His mas- tery must be complete to give him the right to exclude non-combatant vessels or vessels engaged in inno- cent commerce. Japan recognized this in 1905 when she established “de- fensive sea areas” arld made provi- sion by which an innocent vessel ap- proaching them could clioose a route of safety away from or through such waters. The prerequisite now recog- nized as essential in establishing and maintaining a “war zone" is that it he ctually and effectively under the control ot' the belligerent, and that it be so administered that an inno- cent vessel shall not incur risk ex- cept through its own choice. The German "war zone" has by pro- clamation been extended far beyond any llniit over which the naval forces have effective and complete control.
