Dow- ling testified that he was in charge. at the local Polce Station the Sun- day afternoon of the accident and he went to the scene. He did not measure the various distances but. 'stepped off' four paces. three yards he said, from the white lines marking the pedestrian crossing area to the front of plain- tlff'a car. The same car, he stated. was about one. foot from the gutter The Shepherd car was facing east on Grafton with the rear near the Dotherty car and on a slight angle. He said the cars were not touching. when questioned by Mr. Foster he said he would not swear to the exact position of the Shepherd car. but the rear was about in the cen- tre of the street. He stated he saw no brake marks on the street, not any glass or clay. The damage to the Dotherty car that he. saw was ion the side not on the front. Mr. Earl Shepherd. another son of the defendent, said the car in which they were driving belonged to his brother, Ralph Shepherd. who is now in Quebec. Witness was riding in the front seat and noticed they had a green light as they made the turn off Weymouth street to Grafton going east. on their way to New Perth. He told the Court that "Mr. Dotherty ran into 'us” and that the other car was about three feet over the centre line when his car turned. Cross Examination Under cross examination he said he would not estimate the speed of the Doherty car, but it appeared to be coming fast.
