The appeal of Joseph Gallant of Summerside against a conviction of unlawful sale of intoxicating liquor last May was granted at a special sitting of the Supreme Court in Summerside yesterday, Hts Honor Mr. Justice George J. tweedy presiding. Gallant was con- victed in county magisti-ate'a court on May iilst and fined f200.00 and costs by Magistrate R.S. Hinton, Q.C. Mr. D.O. Stewart, Q.C. was crown prosecutor, while Mr. J.A. MacDonald Q.C.. of Charlottetown represented the appelant Three witnesses gave evidence for the Crown. Cat. William J. 'Leach. R.C.M.P.. Vance Mugridge. Summerside and Wendall Mann. Kenslngton. Mr. Gallant gave evid- ence on his own behalf. The charge arose from a seizure of six bottles of ale by Cat. Leach and Cat. P.J. Borys on the night of March 16th, 1955, from a car parked on Water Street in which Mugridge and Mann were passeng- ers. Failure of the Crown witnesses to identify Mr. Gallant as the party from whom the ale was pur- chased was the reason given by the court for allowing the appeal. In the case of appellant Robert Gallant, 10, of Borden against a sentence of six months in jail and assessment of 825.00 damages, lrnposed by Magistrate E.H. Strong Q.C. last May 26th for damage to the Soldier's Memorial in Summer- side, the appeal was dismissed as Gallant pleaded guilty to the charge. but the senteance was mitigated. to a one year suspended sentence on condition that he and his father enter into a recognizance with the court to have the youth keep the peace for one year. He was also ordered to pay damages fixed at S2500. Two character witnesses. Mrs. lrene Easton, the boy's school teacher and Mayor of Borden Willard Leard attested to the boy's deportment. Mrs. Easton said he was one of the best students she ever taught; and had known him for three; years. She stated that his attend-i ance at school was excellent, that he maintained a high standing in; grades. was ambitious and never caused any trouble in any way. Mayor Leard read a letter to the court signed by himself and the Borden Town Council vouching for the yough's good behaviour and high standing in the community.
