We referred some time ago to the failure of justice in the matter of the charge against the proprietor of the Davies Hotel. The parties most concerned, both on the part of the prosecution and the defence would no doubt bc glad to have the matter passed over without further notice or comment. We regard the matter as too serious to be thus disposed of. There is nothing pertaining to our public affairs that should be more stxiictlyguardcd than the administration of justice. It is vital to the life of the state that the innocent shall be protected against injustice and that those guilty of violating the law of the land shall be punished. In this case the public Prosecutor pre- ferred a grave charge against a prominent hotel-keeper and furnished to the Court the names of a number of credible witnes- ses to substantiate the_ charge. The charge, if proven, would have involved forfeiture of the liquor selling license of the offender. What the public want to know is why that charge was never brought to trial? Why did not the Pro- secutor appearwith his witnesses at the time and place appointed for trial and ifhecould? Wearenettoldwby,bntwe all know what occurred. confessed, his fine was paid and the case against the proprietor was dropped. He retains his license and is still selling under its protection. The Magistrate stood ready, as we be- lieve, to hear and determine the matter without fear, favor or affection. The fail- ure was not in the Court. The failure primarily was with the Prosecutor, who is after all but the instrument of the Provincial Government. The Prosecutor retains his onice and the Government ac- cepts the responsibility. This method of protecting the license of a liquor seller, and of administering the law is good enough for the Provincial Ministers. It is a legitimate inference that the same method of escape is open and will be kept open to other licensees should similar charges be preferred against them. Let the bartender confess, hand in somebody’s cheque for the amount of the fine and let the business go on at the old stand l There is something more than a failure ofjustice involved in such a transaction. There is such a. perversion of justice that community in the administration of the liquor law.
