This casd wastried in Summer- slde at the November Term of»-the Suprenrecourt before Mr. Justice Fitzgerald `~ and e. jury. The jury found a verdict for the plaintiff assinst the defend- ant, who was the father of the plain- tiff's wife for $2,500.00. Application was made by the defeudant's counsel to have the verdict set aside and for a new trial. Mr. Justice Haszard delivered the judgment of the court as follows: "This is nn' application for a new trial on the following grounds: 1_ “That the verdict was cou- trary to evidence and hy the direc- tion of the-Judge and perverse. 2. “That the damages found for the plaintiff were excessive. "The declaration contained two counts: 1 “That defendant wrongfully en- ticed and procured the plaintiffs wife without the consent and against the will of the plaintiff. to depart and remain absent from the house and society of the plaintiff. 2_ “That the plaintiffs wife un- lawfully and without the consent of the plaintiff departed from the house and society of the plaintiff, and the defendant well knowing the premises wrongfully' and without the consent, and against the will of the laintiff, received. harboured and detallied the plaintiff's wife and refused to deliver her to the plaintiff although requested by the Dlilmuff B0 to do. whereby the defendant lost the society and ser- vice of his said wife. _ “The defendant pleaded not guilty and denied the allegations 'on said two counts.
