Sim,—I observe you are advocating al change inthe Electoral Divisions of this| Province for the Dominion House of Com-| mons. I think you should also advocate increased representation for the Metropoli- | tan County, and that would fully justify, the changes you ask for. ; There is another matter in which | would | like to see you use your facile pen in favor! of. I mean the appointment of a Board of | Claims for this Province—to hear and! determine causes against the Government or its departments. You are doubtless | avere that such cases exist. Take, for instance, the Rustico Breakwater. The | coutractor of that work, through. no fault | of his own, and from causes which he could | not prevent or foresee, suffered great dam- | age, and he has no remedy or redress; but | if we hada Board of Claims, that would consider equity as well as justice, he would have no difficulty in proving acase. The divine royal prerogative shuts him out, and he has no means of redress. A man may come nigh losing his life, as did Dr. Wall at County Line, through the negligence of Government officials, and he has no means of redress. A Board of Claims, where his prvofs could be heard, would decide whether he had » claim or not. Numerous instances could be multiplied in support of this measure. It will not do to say the Government established a Court of Exche- quer, and cases may be heard in it. True, but its distance from this Province is such as prevents cases from being heard, and no case can be entered except by petition, and the expenses attending that court shuts out poor people altegether. In the neighbor- ing Republic, they have instituted at Wash- ington a special Court of Claims, which has # limited and enumerated jurisdiction over contracts between the citizens and the Gov- ernment. This Court hasserved s + model for some of the States, ¢«.q., N, York, in which Boards of Claims }. . been formed for hearing these cases. “A govern- ment that does not recognize” the rights of individuals to even-handed justice, is not entitled to the confidence and respect of the people of this Province. So, Mr. Editor, if you would advocate these mea- sures, and the people would support them, Sir John Macdonald would recognize the justice of the cause, and enact a law that would give us those rights. The antiquat- ed assumption that the Crown can do no wrong, and hence cannot be sued, is not in accordance with modern political ideas. In Germany, the Fiscus, or the Treasury of the State, may be sued in the same way as ordinary persons. In France also, though ina more limited way. In the United States, also, where the law distinet- ly states that it is the duty of an officer to pay certain expenses whose amount is fixed or can easily be ascertained by liquidation, the citizen interested may force the officer tv perform his duty by appealing to the courts for a writ of mandamus. In this country it does not appear that we have any rights against a government, and it ap- pears we are contented to sleep on, as in the days of yore. Awake, Mr. Editor, and let us hear from you. McDonald, daughter of Captain Donald H. McDonald, of Chepstow, died at her home on the 10th inst, aged 17 years. Suddenly, at Rock Barra, on Feb. 6th, after | brief illness of seven days, Catherine, rellct | of the late Angus McDonald, aged 76 years. | Deceased was of an honest and upright charac- ‘ter, beloved and respected by all who knew her. At his residence, Morell Rear, on Saturday, Feb. 2nd, after a few days’ illness, James De- Ireland, and emigrated to Newfoundland in the year 1835, where he resided for a short time, removing afterwards to P. E. Island, and then settled in Morell where he under- went the hardships and disadvantages of an early settler; but through perserverance, honesty and industry, he made for himself a comfortable home. ‘The deceaséd was well and favorably known to the early pioneers of Morell, and on Tuesday a large concourse of people followed his remains to St. Josepii's Church, where the funeral obsequies were con- ducted by Monsr. Macdonald, V. thence to the cemetery, where he was laid to rest. May his soul rest in peace. At his late residence, on Peter's Road, on the 3ist of Jan., 1889. Mr. Wm. Johnston, in the 74th vear of his age. Deceased was born on Sept. 6th, 1815, in the viciuity of Locker- bie, Parish of Drytsdale, Scotland. On Dec. 27th, 1839, he married Miss Elizabeth Cowan, and in May, 1845, they came to P. E. Island. On Sabbath, the 27th Jan., he was at church as usual, though frail from the effects of a paralytic stroke received in October last, and on Monday evening, while conversing with some neighbors who had called in, was sud- denly struck again and never spoke till he died. By his death a forty-three years’ con- nection with the neighborhood is dissoived, a forty-nine years’ enjoyment of the married state brought to a close, and the end of a seventy-three years’ race reached by an in- duatrious, kind, genial old Christian gentle- man, whom to know was to esteem and re- spect. Mrs. Johnston still remains to mourn his loss, as does also a large family of sons and daughters.
