Prisoner was then crossexamlned by E. H. Strong, K. C., who asked if the cheque transactions between him and the parties you bought fox pelts from was the year before you received the $1,800 from B. I. Rayner and $1,200 from E. 1-I. Ray- ner. Prisoner answered “Yes." Did you make any advance pay- ments on furs for B. I. Rayner or E. H. Rayner after you received the money? “No.” Was there any new transaction, or did you purchase furs for B. I. Rayner or E. H. Rayner or Rayner Fur Sales? “No." He admitted being in Montreal in Dec., 1931, and receiving cheque for furs, and receiving 1| statement in regard to fur sales but that hc had destroyed it as soon as he had paid the shippers. He did not know anything about a circular for Ray- ner Fur Sales. He had no dealings with Rayner Fur Sales. I-Ie became acquainted with Rayner Fur Sales on Dec. 26th. He admitted sending a telegram on that date to Rayner Fur Sales, Montreal, stating that he would buy skins and had one hundred on hand. Asked by counsel lf, “cash for advances received too late,” men- tioned in his telegram, referred to the 01,300 from E. H. Rayner, pris- oner replied, "not necessarily," "probably was." When question was repeated hc said "yes." _ Question: Did you can-y out promises in telegram? Prisoner: No. Prisoner admitted that he under- stood that the money was for fu- ture advances. Counsel for the pro- secution esked prisoner lf he re- ceived a letter from E. H. Rayner asking for an explanation why he had not shipped any furs and that he was to let him know at once, “as the money entrusted to him was neither yours nor mine." Prisoner said "yes," and that hc wrote and said that he had used the money to pay shippers who had not been paid for over a year. Asked why he had kept up the deceit of sending telegrams giving the impression that hc was send- ing furs, prisoner replied that he wanted to stave off E. H. Rayner until shippers had all been paid. Prisoner admitted that he had been told. by B. I. Rayner that the $300 given him was borrowed money, and that the money was for ad- vancements on furs for future sales. Prisoner, said B. I. Rayner did not owe him any money. Had no dealings with B. I. Rayner bc- fore. This closed the evidence for the defence and crossexaminaticn. The court then adjourned until this morning at 10.30 when counsel and the court will address the Jury.
