Then, declared defendant, “I took uni

Defendant claimed he tried to get ont
of the left side of the waggon but that

iron and he could neither move our
way or the' other and finally strug
him violently. A man named Darrach
coming in later and helping them. Mr.
Horne swore that when' he' got
away he ran into the barn where he
- grabbed a shovel and warned them to
keep back. Beer after this-, he testified,
struck Horne's eldo-t son. The Mar
ahal separated the'm, and defendant
afterwards went back and struck Mc-
Kinnon twice and put him out of act
ion.. Other evidence heard was that of
Mr. E. L. Harrington. proprietor of
the Highland Hotel. and Parker and
` Relgh Horns, and John R. Mcwilllaims.
