CLAIMS LIRUUR CUNTRRL ABTS ULTRA TIRES (C. P. by Guardian's Special Wire) HAIJIFAX. May 2B~—A noted Canadian criminal lawyer is Con. tending that the Novo. Scotie. liquor control act and: the liquor acts of the diffcrcst provinces are ultra vires the British North Am- erice. Act. Dr. John J. Power, K. C. veteran Halifax barrister, has mov- ed before the full bench of the Supreme Coult oi’ Nova Scotia for leave to appeal a liquor case direct b0 the Privy Council, basing his appeal on constitutional gfhunds. ‘If I am succcmful in my appeal to the Privy Council, liquor acts in every province in Canada will be upset," Dr. Power declared to- night. He is appealing from the conviction entered against Chester Slaunwhite, sentenced some time ago to four months in jail for vio- lotion cl the Nova Scotis. liquor control act. Dr. Power told the full bench that this act was not intra vires the ‘Phelr lordship adjourned the ap- plication until June 9. “If the Supreme Court of Nova Bcotia refuses the application I shall apply to the Privy Council for leave to appeal", Dr. Power stated. “The liquor act is ultra vires”, declared the veteran barrister. Fsection 92 o! the British North America Act deals with the exclus- "ive powers of the provincial legis- lature and: subsection B deals ex- clusively with the liquor question ls a means of raising icvenues for the province and municipalities. The only way it can be done through subsection 9 is by licens- ing saloons and taverns. Subsection l9 dealing with property and civil rights, and subsection '79 dealing with matters of a local and priv- ate nature, are not to be construed to cover the sale of liquor in con- nection with subsection 9. His authority for these conten- tions he gave as a decision handed down by the Privy Council, the highest court of appeal in the British Empire, in 1896. "The whole framework of the British North America Act" con- tinued Dr. Power. "shows that at the time of Confederation, when it was enacted, it was not the in- tention of the Imperial Parliament that the provincial or dominion crowns were to enizacc in the W- cupations of vendors. traders Or manufacturers. That tvas the view taken by the Privy Council in Canada that such powers of such crowns were lczislzitive, executive or administrative only." The whole nature of legislation o1 the provinces and the Federal Government had changed so great- 1y in the last 50 years end 5° many anomalies were apparent that the whole British North Am- erican Act would have to be re- frained. tho attorney contended.
