Nicholson appearing for the Crown and J.O.C. Camp- bell. Q.C.. for the defence. The cross examination of Au- guste Savoy. superintendent for Anglln-Norcross (Maritime) Ltd. at the time of adjournment the previous day was continued by ” ' counsel. The witness was questioned at some length regarding two re- celpts signed by Domonlc Doyle for work done for the Federal Building project, one in the amo- unt of 5279 and the other for 3527 both of which were dated October 15. 1955. Mr. Savoy produced re- cords showing that the cheque for 3279 was recorded in his state- ment to Montreal, but he did not recall having seen the one for the larger amount. The receipt for the S527 wts apparently for the rental of three trucks. At this point the Magistrate issued a war- ning to the witness "to be careful of your evidence”. QUERIED RE CASH Mr. Campbell asked witness if the cash balanced with the state- ment on which the S279 payment appear, to which he received the reply that it did. Counsel then asked that "if Doyle had been paid the 3527 your cash would have been out." The witness then stated that there had been a shortage of 8250 last fall about the time of the date of the receipt. "It is to be assumed then that you sent false records to the com- pany" said Mr. Campbell. to which he received the reply. "Yer - that is right". When asked about the system of making up the payroll and is- sueing of cheques. witness stated that. Lee made them the payroll under his (Savoy's) supervision" and they were initialed by wit- ness who also signed all cheques issued on the trust account held at the Bank of Commerce. The witness verified Mr. Campbell's statement that all employees of' the company handling money were bonded and possible insured. Mr. Savoy stated that cheques accused and presented in him for signature. On some occasions witness said that he had signed cheques which were not filled out. Mr. Savoy said that since Lee had been away from the job he had been doing tllc books himself. to which Mr. Campbell asked. ”Does it not seem strange that a large international concern handling a 32,200,000 job has its foreman keeping books?" Witness said he did not discuss the affair with Lee when he took his (Lee's) pay down to the hos- pital and that he had no reason to suspect that anything was wrong. It was difficllt to think there was anything wrong with Lee a any time. Mr. Savoy re- marked hat "he was still of the opinion that Lee did not take the money" and that he”had such faith in the boy" he still believed Lee was the victim of the holdup. Mrs. Mary E. Prunty. teller at the Bank of Commerce. testified that she knew the accused from his visits to the bank and con- firmed that Lee had been into the Bank on the morning of April 20 and cashed the two cheques be- tween i0;30 and 11:00 am. She said she cashed the smaller che- que first and did not notice where the accused placed the money. being occupied with making up the cash for the ledger.She said that Lee generally carried a canvas bag to place any money in. but oould not be certain if he had done so on the day in question. The hearing was then adjourned until Monday morning. Other cases on the docket was one charged with vagrancy who was sentenced to thirty days in jail and three drunk and incap- ables, two of whom received sen- tences of ten days and the other twenty days in jail.
