Mr. Justice Elphege Msrier in superior Court turned down a Montreal Pharmacy request for an injunction against the Frosst Com- pany. , The Frosst Company have re- fused to deliver thet merchandise because the Montreal Pharmacy had sold identical products at a price lower than that fixed by the Frosst Company to the public. In the application for an in- junction. the Montreal Pharmacy attacked the right of the pharm- acy manufacturers to fix .retail prices for its products. The Judge found that the con- tract. contained a condition that the merchandise would be sold by the retailer at a price not lower than that stated in the Front Company's catalogue.
