I., June 12.- The prohlhitionAet has been in forcea. week to~day , and no conviction has yet been obtained thereunder, although the saioons are openly violating the law. The Act only applies to Charlottetown, and was not submitted to u vote of the citizens before coming into force. It is believed a majority of the citizens are opposed to }:‘rovincial Prohibition as be- ing inefficient in its scope. There orc also grave doubts us to the constitutiona- lity of the Act, and as a consequence its enforcement his received a. serious blcn by the resolution of the City Council at the meeting on Monday night. The ‘Council decided that the police olllcers must take no partin prosecutions under the act; that the enforcement must be left with the Provincial Government. This ties the Act up at present, and the out- come of the contllct between local and civic authorities ls watched with interest. The above despatch, together with oth~ ers of similar purport has appeared ln"a uumberof newspapers in the Mainland Pro vlnces. Its authorship whether at first or second hand can be easily located when it becomes necessary. It no doubt ex- presses the wishes of the saloonmen and their abettors in the City Council. There is no doubt that they hoped to “tie up the Act" by resolution of the Council, but at the first pull on the string yesterday morning the boasted knot came untled. The Marshal and police concluded, very prudently, to serve the papers issued by _ the Stipeudiary Magistrate and so the tie-up ended rather lngloriously. As to the boast that the “saloons were openly violating the law” at the time t-he des- patch was sent it was simply untrue. It is a fact that during the first week of the la.w’s operation there were no open viola- tionsot the law. As to the further boast that no convictions had yet taken place when the law had been in operation barely a week, the truth may be admitted, and it is in no way remarkable. Even had the violations been open and frequent there had not been time for the Court to do its work. The complaint that the law was not submitted to the people is really lauglr able. We have had some experience of the Canada Temperance Act when it was voted into force by good majorities. The illicit liquor sellers had not any more respect for it on that account. as' was proven by the fact that they were dned right and left and many of their number spent months in jail as the result of their violation of a. law that had been submitted to popular vote. There is some evidence that they have now a more wholesome re- gard for the provincial law with its heav- ier penaltles than they had for the Scott Act. _ The “give doubts asto the constitu- tionality of the Act.” are simply an echo‘ of the resolution passed by the Council. Probably the Minister of Justice, who has pronounced the law valid. is a somewhat higher and sounder authority on constitu- tional law than the Globe’s Charlottetown correspondent. Be that as it may the “serious blow” against the enforcement of the Act as delivered by the Council is not apparent. The law will be enforced. And so far, despite the reports sent lottetown has seen for years past. .
