IN the matter of an application for execution, to be issued against the lands of Theophilus Wood. of Lot 49. in Queen’s County. in Prince Edward Island. farmer. deceased. and all his former right, title and in- terest therein, under the provisions of the Act of the General Assembly of the said Island, passed intbe 24th year of the reign of Her Majesty Queen Victoria, intitu- led “ An Act in amendment of, and in addition to the acts relating to judgments entered of Record in the Supreme Courtof J udicature,” upon a certain judgment entered of Record in the said Court. in a cause wherein Thomas Bolton is Plaintifi' and the said TheOphilus \Vood, Defendant, Whereas application hath been made to this Court on the part of the above named Plaintiff. Thomas Bolton. stating that the sums of ninety-five pounds. nine shillings and nine-pence euro rency, debt. and three pounds. costs, together with in- terest on the said sum of ninety-five pounds, nine shill- ings and nine-pence. currency. from the 3rd day of July. in the year of our Lord one thousand eight hundred and forty-eight (1848). are due and owing to him on, and secured by a certain judgment entered of Record at his suit against the said Theophilus \Vood. in or about Trtnity'Term, A. D. 1848. for the sum of one hundred and fifty-nine pounds, three shillings. debt. end the said sum of three pounds, costs of suit, and execution on suchjudgment hath been moved for on behalf of the said Thomas Bolton. It is ordered that unless all. or some of the persons interested in the lands formerly be- longing to the said Theophilus Wood, deceased. shall, on the twenty-first day of July next. at.
