That, upon any petition, under this Act, being resented to the Chancellor, or to the Court of Chancery, it shall be lawful for the said Chancellor. or the said Court of Chancery, to postpone making any order upon such peti- tion, until the right of the petitioner or petitioners shall have been declared, in a suit duly instituted for that pur- pose.
