Canada gave provincial counsel a. rough ride as seven provin- ces battled a railway attempt to reopen a freight-rate decision of the Board of Transport Commis- sioners. ’ A barrage‘ of questioning from the bench - much of it. aitlcsl o1 some aspects of the board judg- ment - was aimed at Wilson F. McLean, K.C., provincial counsel, through most of the day as he completed the argument for seven Provinces against the Canadian Pacific Railway appeal. Two of the justices used the term “incredible" to describe board procedure in one phase of the case. Another said he was "scand- allzed." After spending much of the day handling inquiries from the bench, Mr. McLean closed his case just before adjournment. C.P.R. coun- sel C.F.H. Carson, who spent two days of the three-day hearing on his main argument. will end the case with rebuttal evidence to- morrow.
