Sir,—At the City Council meeting last night, a petition was presented from cight- een persons, styling themselves the Execu- tive of the Citizens’ Temperance Committee, asking for the dismissal of City Marshal Fiynn, and the appointment of Mr. George Passmore ii: his stead. The only reason assigned by the petitioners for the Mar- shal’s dismissal was that he, as Chief of the Police, did not see that the Scott Act was more stringently enforced. When the many difficu:ties that stand in the way of a proper enforcement of this Act are con- sidered, the City Marshal should not be obliged to shoulder all the blame in con- nection with the matter. Besides, the City Council, some nine months ago, specially appointed a man to prosecute Scott Act violators, whe has had as his assistants the policemen and others, and still it has been found impossible to restrict the liquor traffic. Why, then, should the Marshal be held solely responsible for that whieh this special officer and his many aids are unable to accomplish? Some one, it appears, had to be made a victim of, and the Marshal was selected. First he was put on trial, afew days ago, for drunken- ness before the Stipendiary Magistrate and Police Committee, consisting of Councillors Horne, A. A. McLean and Byrne, and, after aful] investigation, was honorably acquitted. The next move was the petition referred to. As stated at the Council meeting last eveming, by Mr. A. A. Me- Lean, the :Marshal had served the city faithfully and well for over nineteen years, and that it seemed cruel, after so long a service, to be dismissed with only ten days’ notice at this season of the year. Council- lor McLean also said that the present City Marshal's capability, moral character and temperate habits would compare most favorably with those of the gentleman who was named as his successor. If Marshal Flynn had been guilty of any offenee that would warrant his dismissal, there might be some exSuse for the City Council grant- ing the reqest of such a small number of petitioners ; but there was nothing charged apart from what has already been stated, and therefcre we are led to conclude that there must have been some ulterior motive in the Cvuncil’s hasty action. The sole control and management of the police force is vested inthe Stipendiary Magis- trate, with the power of suspending or dis- missing any Marshal or policeman. If the Magistrate was aware of any dereliction of duty on thé part of the Marshal, he should, enjoying the powers named, have either suspended »r dismissed him if circumstances warranted ‘t ; but the fact that he has not doue so, stems to indicate that he is per- fectly satisiied with the Marshal’s conduct. Everything considered, your correspou- deat cannot see how matters are to be im- proved by dismissing an old and capable at the head of our police force .at a time when the very best material is required.
