AMINER. —S—eae ee —- — —- Tut ix 4 A Dany MAY 5, 1883. The “ Patriot” on the Quebec Deiegation. The ex-Gaovernor still conti ues hig silly and selfish opposition to the just claim of this Province regarding the maintenance of our public piers. As soou as the question was raised Mr. Laird saw that its settlement in favor of the Island would demoustrate (if auy demoustration were uecessury) his use- map, avd worked steadily ever since to write down His great hope appears to be that claims shail be advanced by the other Provinces which the Federal Government cannot concede, and which muy to offset. ours, and compel the Dominion to refuse all. less they might iseur a charge of favoring Prince Edward Island. Quebee been. and stil! is, the great bugbear with the Patriot. A momh or two ago, it announced that Quebec was to come forward with a big ¢ aim for the mainu- teuance of its piers, 2nd that Sir Hector Langevin’s reason for receiving our appli- cation favorably was to give a colorable Lassess AS A public our case. serve has excuse for grautiag the claim of Quebec. It turns ont, however. that Quebec has vo claim for the maintenance of its piers. That these works have ever since Cou- federation been maintained by the Federal Government. But the Patriot is still unsatisfied. A delegation from the Quehee Govervinent has receutly been at Ottawa urging a claim for that Provinee for the payment of the per capita allowauce of 8) cents on the increase of population as shown by the last census. In support of this claim it is reported that the Quebec deputation have advanced the argument that certain charges devolviog on the Local Government among them the = admivistration — of crimiual justice, bave increased beyond expectation siuvee Confederation, and that to meet this increase the 80 cents should be paid on the increase of population. It does not appear that the Quebec delegates took the silly ground attributed to them by the Patriot. that the Dominioa Gov- ernmeat onght properly to deiray all charges arising cut of the adminuisirationu of crimival justice,as it alone has jurisdic- tiow in the making of those laws.” Ii is not true that the Domivion Govern- meut alove has jurisdiction in the making of Lews relating to the administration of crimiual justice. The British North America Act gives the Federal Parlia- meut the right to Legislate on ** Criminal Law, excepting the C mstitution of the Courts of Criminal Jurisdic- tion, but including the procedure iu crimival matters.” It also gives power to the Local Legislatures to make Laws respecting the adminis- tration of justice, includieg the ecou- stitution, maiutenance and orgaviza tion = of Provincial Courts, both of Civil avd Criminal Jurisdiction. aud including also the procedure in civil matters ia these courts. Mr. Lairds iguorance of the coustitution of the Dominion serves to show bow unfit be was for the public positions he has oecu- pied. It is more thau probable, how- ever, that bix ignorance in this case is feigned, for be goes on to say that ‘the aame lise cf areumeni which our Delegates employed in regard to Piers eould have served them ith making the Domini defray all the expense with the ** admiuis- tration of crimiual justice.’’ Our claim iu regurd to the piers is based on the plain words of the British Norih America Act, which speciticaily includes these strue- tures io the public works which were passed to the Federal Goverument, and gives the Federal Parliament sole voutrol of all matters rejating to Navigation aud Shippicg. Trade The claim of Quebee, if made as the Patriot indicates, is a demaud terms Our claim iv regurd to the Piers, as well as Wiuter Communication, is forthe tul- filment of the already us.
