P. fur Queen’s County, William Mer- -hant vs. James Lewis, assault and _ bat- tery This before the Magistrate for hearing last Saturday, and judgment was given today. The facts vere as follows :—William Merchant and a companion went in bathing off Mr. Mr. James Lewis’ land, August 15th las! After themselves they per- ceived two boys coming out of Lewis, tield with turnips in their hands. Mer- chant also saw Mr. Lewis coming after them, whereupon he called out as he said himself to his companion. However, the boys took alarm and escaped from Mr. Lewis, who, thinking that the warning indicated an association with the turnip thieves, caught Merchant by the neck and dragged him a short distance. The Magistrate held that as a property holder has power to put under arrest any me stealing from his premises, and as he had a good reason to believe from the warning call, though according to the evi- jence he was mistaken, that Merchant was a party to the theft that had just committed, he was justified in seizing him, and had all the protection of a police officer in a similar position.
