Silence seemed preferable to a manly ace | knowledgment of error, and so the readers | of the Patriot are left in ignorance. ~The organ now musters courage t0@re< ' turn to the subject, but only to make into less huwiliating than the previousone. It undertakes to argue that the Minister of Railways has the power to locate the first ten miles of the Murray Harbor Railway, independent~ ly of the Goyernor General in Council, in the face of section 1 of the Act of 1899 which authorizes the construction of the road. Here is that aection : another error scarcely “The Minister of Ratiwave and Canal- Troi 4 prict oO" may construct s railway the Prince Edward Island Railway at or near Charlottetowa, toa point at or near + Marray Harbor, as a public work; and the « Government “Railway Act sliall apply to y such railway, and the location and al] other incidents of the work shall be de- termined by the Governor in Council.” The legal Juminary of the Patriot con tends that the Government Railways Act must be read with the Act of Jast session» wod then proceeds to quote from Seetion 5 vf the Government Railway Act of 1886, “(m) Change the location of the line of railway in any particular part at any time, for the purpose of Jes-ening a curve, re- ducinga gradient, or otherwise benefiting such line of railway, or for avy other pur- pose of public advantage, &c., &c.” All we have to say regarding this sec- tion isthat, in our opinion, it has no re- ference to locating a new railway éuch as the Murray Harbor Road, It is merely a power given to the Minister to provide for the improvement of existing lines. We go further and say that even if the sub section we have qaoted was intended to have a gen2ral application to the location of new lines, the special provision in tte act of iast session which declares that the location of the Murray Haibor Ra'lway shall be determined by the Governor in Council must prevail. When the organ gays: “‘Iltis the first time we have ever heard of a line of railway being located by Order in Council” it compl-tely sur- renders the whole position and admits that no part of tbe Murray Harbor Railway has yet been legally located. Apparently conscious that the law is against it,the organ goes on to plead its case on other grounds; ani here is what it says: “There is no dispute whatever abou: the location of ‘the first ten miles,’ therefore the Government has nothing to do but to accept the site fixed by the engineers of the Minister of Railways. This is how, as a matter of course, it is done in every case where there is no diepute, apd no doubt has been donein this case. When two linee have been surveyed ard it is necessary to decide which shall be chosen, the Government sball in such cases deters mine the route; and the Engineers shall ‘set outand acertain such parts of the lands as are necessary and proper’ and shall make surveys, etc , for fixing the site of the railway.” Unfortenately for the Patriow’s rea- soning, the state of things which it as- | fumes regarding the first ten miles is the very opposite of the fact.
