Wit- ness hurried out door and caught up with a man with bag of flour under his coat. Witness said "Here give me that. What do you think you are trying to pull ofi." He handed it over. The man was Leo Savidant. It was previous to that he had been delivering ice to the shop. He had no doubt about it bc- ing Leo savidant. He had thc bag under his arm and under a light weight overcoat. Witness started clown street and plaintiff followed. Witness told him he would hear more about it, and he asked not to have him up to the police station. He remarked as near as he could remember, it was a. Savidant who took the flour. He did not think he discussed it further with his father. He had not seen Savidant in shop after until last spring, a few days before the council meeting at which this matter vaas brought up. Wit- ness saw him talking to his father. After he went out told his father that was the man that took the flour. Plaintiff never came in the store, and saw witness alone. It was not Frank Savidiint who took the flcur. Witness hnci no doubt in his mind that it was Leo he took the hag of flour from. He saw Frank Savldant after the meeting“ of June 13th. Witness was on bicy- cle. Plaintiff called him over and said "your father made a mistake the night before." Witness made no answer. ' Witness told Bavidaiit that he had better go after the job of booth keeper in the Park. Savidant had been afraid he would lose his sight. Later Savldamt same to see the wit~ ness on the matter of having witness help him get the job of keeping the refreshment booth. Witness said he would do his best to help Savidaiii, and the latter left. No other per- son was in the shop except l-Iarry, while witness and 1ilaiiitiif were talking. Witness had told Saviciaiit to go and see'Mr. Hennessey and the other councillors. After Siivid- ant left, Harry came in and asked, “What's that fellow want." I told him he was after the restaurant booth in the Perk. "Why, he said. that's the man that took the bag of flour, I'd help him." Witness knew that his son was referring to the incident that happened three years before. Councillor I-Iennessey told witness that Savidant had an accident with a gun while handling Leo Frank's goods. Hciinesscy had been at Leo Frank's residence just before it happened. Mr. Savidaiifs application came up for the posi- tion among other applications. There was some - iscussio on the matter, as some councillors desired to have the booth removed. Councillor Reardon proposed that Savldant should have the position on account of his blindness, and gave him a‘ splendid character. Witness had heard different. “I got up and said.
