At approximately 3.30 p.m. on the day he had responded to a call to the rear of Hoiman's store where he found Roy Ford, bleed- ing from the nose and mouth. He said that he arrested the accused about seven o'clock that evening on First Street in front of Maynard Peri-y's barber shop. He said that he had seen them together sev- eral times that day. Under cross examination he said that when :i-t-iving Mr. Ford around to see if he could identify alI)'ll)Odjr' they did not call at the homes of the accused. He said the reason for this was because he knew they would not be home. He testified that they had not been identified by Ford before they were ai'i'esied nor had Ford been given s chance to identify them on Tuesday when he was in Town. the day before the preli- minary hearing. He (Ford) identi- fied them on Wednesday in the court room where they were un- der arrest and awaiting trial. but before the hearing commenced. Mrs. Herbert Matthews of Alberton met with an accident just beyond the railway crossing at Portage. Boxes containing the poults were piled in the back part: of the car and due to the roughness of the road some of them slipped forward. in- terfering with the driver's control of the car with the result that it overturned in the ditch. Mrs. Matthews had considerable diffic- ulty in getting out or the car btit apart fro.m bruises was not in-,iur- ed. some of the poults were drowned in water that lay in the ditch but others escaped with a chilling.
