Palmer very judiciously and properly complied; it being the duty of every member of a particular society, vo- luntarily to submit to the will of the majority, when that submission is accom anied by no personal degradation or loss of honor. sking a false oath does not neces- sarily imply, thst the party has been guilty of perjury; and, although Mr. Palmer may be, and probably is as well, if not tnore fully convinced, that Mr. VVhelan has no legal qualification to entitle him to a. seat in that I-Iouse,_as he was before the -investigation began, yet he did right in retracting the words which implied that he had been guilty of perjury. He was of necessity, obliged to make some sacrifice of his own personal feelings to a sense of the duty he owed to his constitu- ents; who would, in case of his contumacy, have been let! unrepresented, and that, too, at a time when many matters in which their interests are concerned, are un- der consideration. It was matter of licy to succumb for the moment, as it was evident nothing would have given more sin- cere lessure to the artisans of Mr. Whelan, than that Mr. almer should ve declined to act in accordance with the resolution, and thereby rid them of an oppo- nent who has been, and will continue to be one of the most powerful obstacles to their continuance in ofiicc. There was another reason which, we doubt not, had much weight with Mr. Palmer. Among all the votes of the House, there was not an opinion expressed, which tended to exonerate, still less honorably acquit Mr. Whelan from that suspicion of the offence, which neces- ssril arose out of the evidence adduced at the bar. Mr. larlr openly expressed himself, as not having his mind b any means relieved from suspicion, with respect to Whclan‘s qualification. ' Under all the circumstances ofthe case, we are-we repeat—satisficd, that Mr. Palmer could not have acted otherwise than he did; and, that he has come out of the alfair without the slightest loss of honor or decrease of reputation. VVe must not, however, be understood as willin to afford any sanction to the personal remarks and filusions to private character, which are so fre- uently resorted to, and are so great a scandal to the ouse of Assembly. Had not the provocation given by Mr. \Vhelan to Mr. Palmer, been of the grossest nature, the conduct of the latter would have been high- ly re rehensible; but we must say, we can go great lengtlis in extenuation of language, however severe, which is provoked by a dastardly, unmanly attac on the memory of ii deceased father. Mr. Palmer, has, it Is true, retracted the accusation of perjury, as connec- ted with Mr. Whelan’s swearing to his qualification, but we shall crave leave to suspend our opinion on that pcore, until we have carefully silled the evidence. VVe hgyrnot only no respect, but the most perfect contempt for the decisions of the resent House of Assembly in matters connected with e ections or election law; there not being a single member on the Government side of the House capable of formin a correct opinion on the gubject, setting aside the blin aess superinduced by the ° otry of party seal. e perceive in the Royal Gazelle of yesterday, that ‘the words "He retracted the charge accordingly, ’ are t in Roman capitals, for the purpose of attracting at- tention.
