The communication to the Ottawa. Government was handed to Hon. Vincent Massey, Canadian Min- ister to Washington, and was in re- ply io a request by the Canadians for information concerning the incident. The apology of the United States contains the admission that the fir- ing upon the Canadian vessel had been "without legal authority." In reviewing the facts of the in- cident, stated in the United States note to have come from appropriate authorities and understood to be based on the coastguards report of the firing. the communication charg- ed that the Shawnee was a vessel en- gaged in smuggling liquor and built especially to violate United States| laws. The Coastguard boat came up on the Shawnee some 15 miles of! the nearest. land in the vicinity of New York Harbour and alter the Canadian vessel is alleged to have ignored signals by horns, lights and blank shells. the patrol boat fired five shells into the ship.
