The evidence shows that cer- tain iiquor was found concealed in a manure pile back of a barn west of the Agricultural Hail, Summerside which is used by the accused and a truckman called Clark. The place where the liquor was found is open to the public and accessible on three snot in his car by a drive way along sides. Mr. Barbour drove to the the south side of the barn. no gates or anything to prevent anyone ent- ering. While driving in he saw the accused going in their direction by the south of the Agricultural Hail. This is as near as the prose- cution gets the accused to the man- ure pile in question. They found a man John Gallant in the barn when they found the liquor. On this evidence the prosecution con- 1 tends that by striking out the word “knowingly" in the original act and merely finding liquor on premises is prime. facie evidence of the guilt of the owner without any knowledge on his part that the liquor was there. I do not see my way clear to accept that proposition and I do not think the statute bears such construction. The customs act as amended in 1927 has a proviso that where the goods found is liquor the burden of proof that duties paid rests on the claimant or persons in whose‘ possession the goods ar found what iS the possession contemplated. Instead of taking the definition of l the prosecution I prefer to accept that of the Supreme Court of New York in Sultan vs. Sul1ivan,_whcre right to deal with the property at pleasure adn to exclude other per- sons meddiing with it."
