April 16. Mr. Speaser took tlio Chair at 12.30 o'clock. Mr. Sciirvax, as a member of the Execu- tive Council, presented the petitions or the inbab.tarts of Montague Bridge and vicinity asking a subsidy of €750 00 a year for five years, for the establishweut of Sieam Com- wunieation on the Montague and other Rivers. Mr. Martiw asked leave to present the petition of certam inhabitants of Pivette,. Belle Urceke, Flat Rever, Wood Islands, Garfield, Culloden Ponds, Little Sands, Murray Harbor, Poiut Prim, aud others, praying that the Government wiil mk such arranzementa as wil] give them neces sary Steam Cominunication with Charlotre- town. Mr, SULLIVAN said the proper course for the Hon. mewber to pursue was to send the petites to the Government Mr. Manis said he had done so, and had been informed by members of the Government that they could not present the petition to tne House Mr. Srintvan—He had never heard of the petition til about an hour ago; and if the hon. member desired to render the peti- tion+rs a service he would hand the petition to the Gwerament. The petition could not, under the rule which provides that the initiation of money votes shall lie with Government, come before the House. Mr. Miura said he handed a duplicate of the petition to the Commissioner of Public Works about three weeks ago, and he thonght the petition shon!d at least be presented to the House But sshe was not. allowed to do so, he would ask the Leader of the Goverumert if the Govern- ment have received a petition from the in- habitants of Pinette, Belle Creek, and other places, praying that the Government will meke euch arrangements as will give them necessary steam communication with Charlottetown; and if so, what action has been taken on said petirion, and, whether it is the intention of the Government to geant the prayer of said petition. Mr. SuLiivas said he was pot aware till now that ench a petition had been sect in to the G..vernment, very |! ts tam aa having thus been brought to the subject, they discovered that 1 e wharf or pier in que Government. The 1l08i:h section of the | | British North Ameria Act, provides that | vested im t ‘the Public Works and property of each Province, enumerated in the third Schedule of this Act shall be the property of Canada,” and turning to the third Schedule referred | to, we find that, included in the pubhe Pro- | ironsferred to CU i by the Act | Uanada were ** Publie— Harbors,” -‘‘ Piers” - aud | * River Improvements portly Now the harbors ! of this Province are all ‘‘ public harbors,” | and the piera with some few excé ptions, | all beleng to the public. The Terms of | Union entered into between the Island and | the Dominion, set forth that ‘the Dominion | Government siiall assaine and defray ail the charges for the following services, mR oP / thes cha ges dx may he incident necied w services Which by } America Act, 1867,” apper-} sencral Governmeut, AND AS ARE | Be ALLOWED Al ta, and con the B itish Novti trin to ihe OR MAY VINCE.” And,— ‘That the Provisions of the ‘British Yo: th Americ: Act, i867,” shali, except those parte thereo! which are in terms inade, or by reagon- ible intendment. may be h- id te be especially pp icable te, and on'y to eff-ct one and not the whole of the Provinces now composing the Donanion, and exc. pt so far as the rane may ve varied by those ra@olutions, be applicable to Prince Edward Island in the same way and to tie samewex'ent as they apply to the other rovinees of the Dominion, and as if ths Colony of Prince E-iward Island had beeu ove of the Provinces erigiually uaited by the said Act.’ On these grounds the present Govern- ment of this Provines felt satisfied that it vas no part of their duty to construct and naintain any of the public wharves of this Island. Alc«cur public wharves or piers ire in public Harbors or navigable rivers, snd are used for purposes of trade and aavigation; and all became, when we entet d the Confederation, the property of the Dominien Government. So that not only was the maintenance of the wharves a charge upon that Government, but we had a lege) and an equitable claim upon the Dow ia- ionGoverument tor all the moneys expended ipua them fron the date of Confederation Here it moy be remarked that had t! site ‘ h, ti ne Government acted in accord with a certain resolution lately passed by the Legislative Council, to the effect that we should have affirmed the right of this Province to the value of all piers or wharves constructed prior to and existing at the time of Cun- federation, they would have thruwn away the whele case. For if the property in the wharves did not pass to the Dominion at the time of Confederation, we bave no claini at all; and itisenly upon the assumption thatthe Dominion Goverament Were bound to maintain its piers, that the Province has any claim whatever t> an indemnity. The resclution passed by the Council is so absurd as to be positively asteuunding ; and it is direct opposition to the interests of the Pro- vines. In 1881, the attention of the Gov- ernment wescailed to the case of Holman vw. Green, which wes then progressing in che Supreme Court of Canada. ‘The Gov- ernment were asked whether or not they would intervene in the case. After some consideration the Government decided not to intervene ; for had they done so their contention must have been against the in- terests of the Province, in upholding the grant to the plaint:ff in the suit, and besides they felt sure that without such imterven- tion the result would be favorable to the Island. The jndgment, as anticipated, strengthened our claim npon the Dominion Government. Chief Justice Ritchie, after quoting the 6. N. A. Act in his judg- ment, said that; ‘*The properly in public harbora beiny thus vested in the Dominion, the svil un- granted at the time of Confederation be- tween high and !ow water marks, and being within the limits of publie harbors, by the express unqualttied words of the enactment, became vested in the D. minion as part and parcel of the harbors, which belonged as proper'y to the Province.” The Chief Justice also said that :-— ‘The cxclusive legis'ative an‘hority over the regulation of trade aud commerce . navigation ard ship- ping is vested in the Parliament of Canada’ And referring to the clause in the Britich North American Act, before quoted, His Lordship said :— ‘Aa therefore, this c’ause relating to pnb- lic harbors is alike appl cable to all the Provinces, and was in no way varied by the resolutions referred to, the same beceme Mr. Camppeci said that he had received the petition and had sent it with others to the Gierk of the Exrentive Council. had, in the nr eantime, been no meeting of the Council, and it had not, therefore, been brought tothe notice of the Government. As soon as there is a meeting. the prayer of the petition will be considered. Me Swiuvax, as a member of the Gov- ernment, presented copies of correspond- ence with the Dominion Government re- specting the case of Holman rs Green. Received and read. Mr. MoLeop presented a Bill entitled ‘an Act to enabie the trustees of the Baptist Church of Charlottetown to sell certain lands.” After recess,— Mr. SULLivan moved the second reading of the ‘Appeal in Equity Act, 1883.” He explained the various provisions of the Bill. House in Committee in the Chair. Mr Speaker resumed the Chair and the Bili was reported agreed to without any amendment. Mr. Prowse as Chairman of the Com- mittee va private Bille submitted a report respecting the Biil entitled ‘‘ An Act to enable the Trustees of the Baptist Cuurch of Charl ttetown to sell certain jande, rec mmending that e fee of 14 be charged. _ Mr. Sciurvax, as s member of the Exec- tive C.uncil, submitted a statement of the expenses «f Moesrs. Comunittee on deapatches resp cting the | maintenance of the Piers of the Province! by the Domioion Government. He said: ' Shor'ly afer the present Guyernment come into puwer in 1879, the necessity of gome_ reyai-. to the wharf at Cape Traverre was Ww thatr notice. Their attuntibka There ; , Mr. J. R. McLean | Pope, Haviland aud | more restri applicable to Prince Edward Isiand as if it jhad been one of the Provinces: origiualiy united by the British North American Act of 1867, ard therefore the Executive Government and Legislature ceased to have any property in, or ex: cutive or Legislative power over, the ungranted lands between high and low water mark in such harbors as that in question.” Mr. Justice Strong expressed himself in this way :— **The question for our decision is there- fore narrowed to this — ‘* Did the 108th section of the British North America Act transfer the property in the s il or bed of this harbor to the Crown in right of the Dominion ? | The land in dispute is situate opposite the town of Sammerside and forms part of | the foreshore or the land between ordinary high and low water maths of Bedequs or Sammerside harbor—a herbor of which the | public have the common tight of user, and |which in that sense at least is therefore a }pnblic harbor. It does not appear that any public works have been erected, or any public money for the improvement of, or in any way in connection with this harbor, |either by the Dominion Government since, or by the Provincial Government before or }since, Confederation. 1 can, however, con- | ceive no other meaning to be attached to ,the words: ‘*Public Harbors” standing alone, than that of harbors which the public have the right to use, and consequently if cted construction isto be put |on those words it must arise from the con- ment of the expen-| text or from ses of Mesers. Haythorne and Laird, while} Aot. on @ deleyation to Ottawa in the same year. | some other provision «f the I find no other provision of the Act conflicting with what thus appears to be the prone focie coustraction of the terms in question.” ,. . . , | t ‘Nat arise the questions — Does the.dv- | scription ‘Public Harbors” include the | bed or svil of the harbor? And if se, is the foreshore also comprised in it?) | am) of opinion that there is even Msy¥ doubt’on this head than on the first pins Dy wre “SAILS EXAMI stion and all the other public wharves | & mere of the Province, belo: ged to the Dominion | ment— TO TUK OTMER Pro- | (lating harbors and taking tolls in them. | would have implied the duty of conserv /ancy, Which could not have been properly Archibe tmakt, LP, ee ee Metin j ' it never could have been meant to transfer franchise to the Dominion Govern- that is to the Crown in right of the leaving the property mm the soil he Crown in the right of the province. Such a constraction would beso arbitrary, unnaturel and improbable, as to be totaly inadmissable, Who ever heard ef such an anomaly as the Crown, as a hody pcliiic representing one Government, having a franchise im the property of the Crown itself as a bedy politic representing a distinct Government! ‘Then the otject of vesting the harbors in the Dominion was donbtless with the object of enabling that Government to carry out with more facility such measnres as it might, under the power granted to it to legislate on the subject of navign' ton and shipping, from time to time think fie te enact. And for this” purposé it was waterial that the right of property in the soil of harbors shonld be under the control of the Dominion, a resalt whieh would not be attained by conferring a were franchise or the police power of regu- Dominion- Further, the taking of tolls or harbor dues performed if the bed of the harbor had been vested ia a different proprietor, Then there would bave been no necessity for this special provision of the 108th sectio) vest- ing harbors im the Dominion, unlesa it was intended to vest the property in the beds of hart ors, for under the grant of legisla tive power relating to navigation. and shipping, Parliament might have assumed all such powers as would have been com- prised in the 108th section, if it were tole construed asa mere grant of franehise, or police, cr conservancy power, or of all these together. The fair inference is there- fore that it was intended to transfer the harbors in the widest eense of the word, including a!l proprietary as well ae preroga- tive rights to the Crown as representing the Dominion.’ These are the opinions of one of the most di-tingnighed Jurists in Canada. Then Mr. GGWY¥nne says :—- ‘Her Majesty remained seized of those harbors and of the land covered with the water thereof, jure regio for the public pur- poses of the Dominion and subject to the exclusive control of the Parliament of Canada.” These judgments as before remarked very materially furthered the claim of the Island —in fact settled the question, in which it was involved beyond dispute. Attention might here be called to the expression ‘‘Public Harbor.” Strange asi' way appear there are private harbors, as dis‘inguished from *‘publie harbors.” Even se impertant a harbor as the harbor of S-. John, N. B. is a private harbor, having been granted by the Crown in the year 1785 to the Corporation of the City of St. John. Last year it was vested in Harbor Com missiovers appointed by the Corporaiion, the Board of Teade and the Dominion Government ; and the Dominion Govern- ment granted $500 000 for the purchase of the Corporate rights of the City, and the construction of whsrves and appliances necessary to the trade of the ports The harbor of Montreal also is a pri- vate harbor; so is that of Quebec; of Sydney, Cape Breton; of Pictou, Nova Scotia; and many others But there are no private harbors on this Island, and we fz]: satistied that legally and equitably we had the right to ask the Dominion Government to make good our claim. But we fortified ourselves stil! further. The terms state that, in respect to harbors, ete., the Island shall be treated as the other Provinces ; and on looking inte the public accounts, and the blue books, we find that the Dominion Yovernment have been constructing and maintaining just such public works as the | piers of P. E. Island. At Fort Darlington Oshawa, Whitby, Coburg, River Blanche. and many other plices throughout the D - minion, the Dominien Government have, year afier vear, made large expenditures on works precisely similar to our piers;—and these tacts also gave streugth to our case.
