Ottawa Notes. ae (Special correspondence of The Examiner. Sir John Thompson on rising was greeted with hearty applause. He cpened with some good-natured remarks at Mr. Tarte’s expense, pointing to the striking contrast between that gentleman's speech of five hours’ length and the resolution which fol- lowed it. It was perfectly ubvicus to every- one, Sir John said, amid rears of laughter, that the speech had been dictated by one person aod the resolution by another, and that the two men had never agreed on any part of the policy. Mr. Tarte had inveigh- ed at length upon the injustice done to his countrymen in the matter of their langusge, and had occupied hours to show that the Government should have disallowed the obnoxious Schocl Bill, yet his resolution contained not one word about either lan- guage or disallowance. Sir John then en- tered into a detailed history of the whole question. He pointed out that under the British North America Act the subject of education was relegated to the Provincial legislatures, under certain restrictious, safe guarding the rights of minorities. For twenty years everything had gone smoothly in Manitoba unt:] 1890, when the objection- able act was passed, and which the Romau Catholic minority claimed should be dis allowed, The Government said that this was a question which ought tu ba decided by the courts. A citizen of Winnipeg brought suit and the Government sustained the cuit before the courts. Sir John then proceeded to defend the Government’s action in the matter of quoting the case of the New Brunswick School Law and the utterances of Sir George Cartier upon that subject before Parliament that the question was not one to be decided by the m j ity, but was to be settled in a spirit of justice with regard to the interests of both bodies. Mr. McKenze’s resvlution, which was adopted in regard to it, was to the effect that the matter was not to be settled by the disallowance of Provincial statutes, but by reference to the law vfficers of the Crowu and the Jadiciai Committee of the Privy Council. Thst opimion was obtained snd it held that the N. B Act was within the power of the Legislature. Then in the case of the P. E. Isiand Act in 1877, the opinion arrived at was precisely to the same cff-ct, that the act complained of by the Roman Catholic minority was not to be iuterfered with by the policy of dis- allowance. The Government's contention was that the question whether the Manitoba Act was ultra vires should be left to the courta, and if they decided it was not so, but that the Act was valid, then would be the time for way of appesl provided by Section 93 of the B. N. A. Act. This was what the Government had done. There were two sets of petitions from the Manitoba minor- ity, One claimed disallowance, the other that the Act was ultra vires. Lay aside the tirat class until this litigation was deter- mined, because there was no case for dis- allowance if the acts were wtra vires. If they were wtra vires they did not need to be disallowed. If intra vires they ought net to be disallowed. Lay aside the peti- tions which ask for remedial legislation, because the first queetion to be decided was as to whether these acts had any force at all. If they had nv force, no remedial legislation was nevessary, and no appeal ought to be carried forward, If it were ascertained that these statutes of 1890 complained of were legal and operative, it would be time enough to consider that class of petitions which claimed remedial legisla- tion and redress. Sir John denied Mr, Tarte’s statement that the rsport of the Government upon the petitions contained any promise whatever of remedial legislation, and also another statement of Mr. Tarte that Sir John Macdonald would have disallowed the Act if Archbishop Tache had insisted upon that course. Mr. Tarte had stated that Sir John Thompson's report, making the so-called official promise, had been penued s0 as to secure Arch- bishop Tache’s support at the elections, while the fact was that the report was not penned until weeks after the election. Some might ask him whether the decision in the sase of New Brunswick was not enough, and why they should again move to litigate with regard to the same question a8 to Manitoba, It was because the righta of the minoriiy inthe two Provinces rested on different statutes. If they had the same statute in New Brunswick as they had in Manitoba, that might have prevailed; but the New Brunswick minority required to show that their rights had been estab lished by law, and the Manitoban minority only had to show that they existed in prac. tice. There was a mixed question of law and fact, and the question was submitted, as everybody knew, to the courts of the country with varying success until it cam: to Ottawa, and the Supreme Court of Can- ada pronounced against the validity of these Acts, and the Judicial Committee of the Privy Counc'l reversed that decision anc declsred these Acts to be intra vires. Edward Blske as to the jadicial functions of the Government in a case like the present, and showed that Mr. Blake's views, which he expressed in 1890, were accepted by Sir John Macdonald, and in the following year embodied in the Supreme Court Act. The exact machinery which the Government had followed in the Manitoba School case, was :hat which Mr. Blake had suggested and Parliament had adupted. Sir John then proceeded distinctly to define the position of His Exceliency’s adviseis sit- ting in a judicial capacity and deaiing with the case, and instanced the proceedings a few years ago before the Railway Committee of the Privy Council, when the question of the right of a railway constructed under authority of the Manitoba Legislature, to cross a road constructed under a Danialen charter, came before that committee for consideration, The R-ilway Committee of the Privy Counei! did with regard to the railway question precis-ly what the Committee of the Privy Council are doing now with the education question. What they did was to submit to His rxcellency that he should lay before the court a case upon whir h the rights of all parties concerned should be decided before they made any decision They might have pursued the course recom mended by Mr. Tarte. They might have made an order for the crossiog, and have put armed men in motion to effect the crossing. The might have left the difficulty to be decided after- wards, bat every man, when the dispute was over, admitted that they took the sufer course, avoided confosion and perhaps bloedshed, at any rate avoided confusion and heartburnings, and submitted the question of the rights ot the parties to :he courts first, aud then acted ou the decision obtained. As to what the pelicy of the government would be after a decision bad been obtained from the courts, Sir John was prepared to give this anewer . That the province of Mani toba wasa constitutional province and whether in hands of legislators opposed to this Govern- ment or ia sympathy with them, there wes every reason to be ieve, and they might rest assured, that she wvuld obey the dictates of the bighest court of the empire as to what the constitution was,regardless of the displeasures of the m»jority if the decision were ageinst them; ana so far as the disposition of this ap- peal was concerned, the maj rity mast bow to that decision snd the Federal } xecutive would advise His Excellency according’y.
