Tus Roya! Gazetic teems with the notices of new appoint- | ments to various offices under the Government of this Island. | Nearly half « hundred new Magistrates were gazetted last, week ; and wo understand that another vatch will be announced in the next Gazetie. Nearly all the Road Commissioners and | Collectors of Excise under the late Government, have been displaced: and, strange to say, even judicial officers, such as | Commissioners of Small Debts, have been cashiered, without | a fault being assigned against them.* The public interest has | likewise been sacrifieed to the demon of party in the removal | of most competent and trustworthy keepers of some of our | Light Houses, and in one cese particularly even the poor ig excuse cannot be alleged that the victim was a political parti- | van; baton the contrary, he was a harmless, inoffensive, | éficient, anil indefatigable public servant, who never todk any part in political strife, and enjoyed the highest character from | the pen of the late Gov. rnor. We observe that Henry Nisaard, Esqr:, has resigned the fee of Colonial Secretary, and that W. IL. Pope, Esqr.,— | beother ef Hon.J. C. Pope, an Executive Councillor—bas been spp vated t) the place. We all know that, for several months past, Mr. Haszard’s removal was a foregone conclusion ; and tumour states, that it was with great reluctance and some difficulty he was prevailed epon to give up the office to Mr. Pope, to whose appaintment the late Governor would not con- | een. This was an action for an outrageous and unprovoked | libel, published against the plaintiff shortly after his appoint | ment to the office of High Sheriff in the spring of last year. | The defendant charged Mr. McGill with fraud in his private | capacity as a merchant, without the shadow of foundation, | and attempted toshow thereby that the Goyerrmenit did. wrong | in appointing lim to the office of Sheriff. Unable to justify” the charge, the defendant's counsel pleaded the general issue, | and reste! his defence on the silly plea, that in assailing Mr. MeGill’s private character, it was not the intention of the Jslancér to do him an injury, but to censure the Govern- ment for appointing him. ‘This was an extraordinary ground of defence, and if tenable, would lead to the most dangerous results. According to the argument adduced by the learned counsel, any public journalist may invent and circulate what falsehceds he pleases against the private character of an official —may assert that he is a bankrupt and a swindler, « thicf, a murderer, or any thing else; and if brought to account for his libellous attacks, may demurely say that be did not intend | to injure the party assailed, but to redvessa public wrong. On the Jury there were eleven persons politically opposed to the) plaintiff, and only one whose principles were in harmony with | bis own. Our readers will not be surprised, therefore, to | learn that no verdict was agreed to—the Jury were discharged ; | wad the ease stands over for further investigation. We believe | that a report of the trial was taken, and assoon asthe speeches | of counsel shall be given to the public, we may offer some | further observations upon it. The Hon. M. I. Wilkins, of | the Nova Seotia Bar, with the Hon. Josoph Hensley, were of | counsel fur the plaintiff; and the Hon. E. Palmer for the de- | fendant. ee GS OY SUPREME COURT.
