Esq., of New London, was sworn Foreman of the Grand Jury. Big Lordship the Chief Justice, stated, that it afiorded great pleasure to the Court, to be enabled to inform them, that the Calender for this Term, though presentin butaslightdi- minution in the number of 0 shoes for their consideration as compared with several of the last consecutive Terms for this County, con- tains but one case of aggravated character, vis., assault, with intent to commit a rape, and is made up otherwise of two cases of com- mon assault; a case of assault upon the Un- der Sherilfof the County, in the execution of the duties of his ollice, and five cases of larce- nies of property trifling in amount. The cases of Larcen require no particular observation from the ourt; they are all of the ordinary description of thefts of articles oftrilling value, and in their investigation, you will apply to them those neral rules of Law which govern the crime ofglerarcenymnd which are briefly sum- med up in these requieites,viz., that there must he a taking and carrying away of the property with intent to convert it to the takers own use without the consent of the owner, and that the intent must be felonious, and such intent must exist at the time of taking, and that the rty in possession of the stolen articles is deemed to have come by it feloniously, unless he prove to the contrary. . In cases ofassault and battery, it may be sufiicient to state, that no language or gesture, however aggravating, justifies an assault in point of w. Two of the cases for your _con- sideration would appear from the Depositions, to have been sent up to this Court by_ the City Court, in consequence of their re rding_ them as cases of rather an aggravate description, and committed under circumstances calling foraheavier punishment than that Court is authorised to indict.
