May 21- - (or) - The supreme Court of Oanadi is being asked to disallow subsidized ' t-rate reductionsvwhich went into effect May 1 on rail traffic between Eastern and Western Canada. Canada Stasmships Lines, whose lake and river fleet competes with the railways for the East-west business. has challenged a Board of Transport Commissioners rate- reducing order based on a 87.000,- ooo-a-year subsidy voted by parlia- ment last year. The steamship company has asked the court to set aside the order on the ground it did not comply with legislation. A hear- ing on the question of granting the company leave to appeal to the high court has been set down for May 28 by Mr. Justice John Cartwright. Westem provincial governments. whose provinces stand to benefit most through the treasury-helped rate cuts, will tight the motion. They may be joined by the gov- ernment of the Atlantic provinces. but this will not be settled until later. The disputed reductions. ordered by the board April 1a. amount to about five per cent on some 3150.- 000.000 worth of traffic 3. year moving between Canada's two main regions. The board ordered the cuts for most types of goods, but -with a number of exceptions including the low-rate export grain traffic; the already-subsidised coal movement from 'the West to Ontario, and "competitive" rates - those dc- pressed to meet competition. The subsidy is pegged to the cost of maintaining the two trans-continental railways' track- age across the thinly-settled North- ern Ontario rail "bridge" between East and West. with an annual maximum of s'1,000,000. In de- termining the amount of the first years subsidy. the Transport Board held these costs are more than 37,000,000. Canada Steamship Lines said its own revenues would also be hit. It estimated. its loss on one type of traffic alone - fifth class - would be cut by 8200.000 a year through dropping its charges to East-West Rail Rates Challenged In Courts SPRING VALLEY W.
