Warner. RC4 M. said he arrived at the scene at (.00 where he took various mea- surelncnts and then prepared pi sketch of the locality. It showed the location of vehicles in relation to the scene. Tile paved highway there was 18 feet 2 inches wide with the right, shoulder being 5 feet. 3 inches and the left shoulder 5 feet 9 inches. The truck was 7 feet 8 inches in front of the Tweedy car, The ance from the 'bad bump' mention- ed ln previous testimony as 429 feet. to the rear of the Tweedy car. It was a substantial bump and there were no others between it and the car. Questioned about various speeds in relation to braking distances he sold under ideal conditions a car at 30 miles per hour could be stop- ped in 50 feet. However. the table used did not apply here as friction of tires had to be considered. The brakes of the car were tested and found good as were those of the truck. A beam under the bodyyof the truck had been injured and had flecks of paint similar in color to that of the car. On the conclusion of Cpl. War- ner's testimony Mr. Darby an- nounced the Crown was finished. Mr. McPhee then moved for dis- missal of the charge. On the de- cision to present the evidence for the defence before argument on the motion Mr. McPliee called J. A. Reardon. of the Department of Highways. Mr. Reardon had prepared ii scale map of the section of the Georgetown Road involved in the case. The scale was 1 inch to 20 feet and showed the section of road ior 800 feet west of the Kin- lock Road and 150 east of it. He stated the road showed indications of poor sub-grading and a heavy weight on top. His sketch and ac- companying evidence described the road, its width. shoulders. grades and indicated the spots where bumps had been repaired this spring.
