[w&stld A Wipow’'s Scit.—A Winnipeg despatch says that the case of Rajootte vs, the Cana- dian Pacific Railway, which is brought by the widow and children of a switchman killed in the yards there by his foot being caught in a frog in October, 1887, came up before a special jury at the assizes to-day. On behalf ot the plaintiffs it was contended that a rail way company is bound to block the frogs so | as to minimize dangers to their workmen as | much as possible, while the defendants con- | tended that no statutory obligation was cast | upon them to do so. At the close of the | plaintiff's case a non-suit was moved for and the judge was of opinion it should -be grant ad. The plajotifi’s counsel would not accept, | and the judge instructed the jury to find a verdict for the defendants. They disregard- ed his directions and returned a verdict for the plaintiff for $5,000.
