M. McCormack and A. Currie. ll seems that an erroneous opinion pre- vails among many farmers that the water front of their farms extends to low water mark and that they have exclusive rights to all seaweed and trafllc, even to the extent of running at water fence to low water mark. thus excluding all tradic and u pri- vate right to seaweed landed by thc tide, whereas n decision was rendered some years ago by Sir Wilfrid Sulli- van in the Supreme Court in Charlot- tetown. Judges Hodgson and Fitzger- iild concurring that a farmer‘s rights were only above high water mark. und that ull rights between low water and high water both to collect sea- weed and ordinary traffic were equal- ly the common rights of the public. The case referred to was Riley vs. Campbell. Riley erected a water fence shutting off travel opposite hit farm und Campbell was sued for breaking through the fence and puss- ing through.
