Upon his arraignment in police court today it was disclosed by J. A.` Ritchie, Crown Att/omey that Mr. Auger had been illegally released. He declared that the criminal code pro- vides that -boil could only be granted by a Judge of the Supreme Court of Ontario, where ia person is accused of murder, treason or any onence punishable by death. The contention was upheld by the Court and Mr. Auger was ordered held in custody until such time as proper bail could be arranged. Raoul Mercier, counsel for the ac- cused polnted out that there would bc no Supreme Court Judge in Ottawa for several days. If the technicality were enforced he would be compelled to apply to o Supremo Court Judge in Toronto for bail. On behalf of his client he asked for a remand of one week, which was granted. Mr. L. M. MacNeiil hav- ing been elected councillor for the West Ward by acclamatlon on nom- ination day. Polling was for the choice of e. mayor, two councillors and one water and sewerage commis- sioner. For chief executive the cm- didates were Mr. W.- J. Lidstone, who has held the premier position on sev- eral previous occasions and is an old civic campaigner, and Mr. B. W. Robinson, who has served with dis- tinction on the Council Board for one term only.
