Counsel for the liquidators argued that the Government's claim arose out of a |Simple trading contract, in which matter the Crown had no privilege over an ordin- ary creditor. The right of the Crown in | relation to minor matters could only be ex- | }ercised in P. E. Island by the Provincial |} Government. This would certainly have been the case before Cx nfederation, and there was nothing in the British North America Act conferring on the Government |of Canada the right to exercise these perog- jatives. The of the Provinces Was preserve d by tha Act,and their several Lieutenant-Governors represent the Queen in the performance of many executive and /administrative acts. Therefore the prero- | gative in this case, if it existed at all, was } vested in the Lieutenant-Governor. Mr. | Fitzgerald quoted the judgement of Chief | Justice Ritchie in the Mercer case in sup- }port of this view, and contending that at | Confederation onty such of the prerogatives | a3 were necessary for carrying on the general | government of Canada became vested in the | Governor-General. He also argued that the Government having elected to prove their claim under the winding-up Act jand accepted two dividends, were now stopped from claiming payment in full. [o | the course of the argument, Chief Justice | Ritchie remarked that if there was a dispute | between Provincial and Dominion Govern- ments as to which should have priority of payment, he would be inclined to rule that the Provincial Government would have a prior claim to be paid before the other creditors. Mr. Peters contended that this was not a matter in which the Dominion Government had a right to exercise its pre- rogative. SE Weight and Measurement of Roots. House of Commons on the 23rd McDonald (King’s) moved for In the in connection with the veighing and measuring of potatoes and other roots, in the Province of Prince Edward Island. He said :— I would just say, in connection with the motion, that this 1s a matter of considerable importance to the people of Prince Edward Island, and also, | dare say, to the farming population of this country generally. I find, at the present time, that there is a good deal of diserepaney as to the way pota- | toes and other roots are bought and sold. In some parts of Prince Edward Island a barrel, holding about two and a half bushels, the charge} lous properties, but creates the is generally used, while in other parts of ‘the Province a measure hoiding about two | bushels is used. Altogether, there is a 'yood deal of dissatisfaction amongst our \farmers as to these differences, and they lead to a great deal of annoyance. I may |say that the farmers generally, and those | who take thejgreatest interest in the matter, | speak, as a rule, in favor of weighing pota- 'toes and other roots. I do not know that it makes a great deal of diflerence to the |other parties, because, whether they are weighed or measured, the price will be 'yvegulated accordingly; but in some portions of the Dominion I find that they are taken | by weight and in others by a bag containing | about one and a-half bushels, while in other | places again they are sold by a two bushel 'measure, which, however, | do not think is lstandard. Altogether, I think _there | should be some greater uniformity with re- spect to the measaring of roots. l am given to understand that in the United States weighing is generally resorted to in buying | potatoes and other roots from the farming | population, though measurement 1s resorted |to in buying them at first hand. There has been a great deal of talk among our farm- ‘ing population with respect to this matter, i } | and some of them are under the impression | that they are unfairly dealt with with re- | spect to measurement; but I think that is ‘rather a mistake. There is no doubt that | whatever the size of the measure 15, the price will be regulated in accordance with it. However, it is absolutely necessary, in | the interests of the whole community, that ‘a uniformity of measure should be used, land I think it would be well that the matter | should finally settled by the Department | under whose charge it comes. and that a uniform measure should be used in all instances.” 5A LIE FOR SALE. rQHE Black Bush Lobster Factory, Lot 45, tel scupied by Doyle & McBride, i a oe That is: oi main building, 52 30 wide; 1 shed, 20 feet long by warehouse, 20 feet long by 13 k house, 20 fect long by 12 wide together with all outfits, 660 lobster traps and Souris East. | feet long by 112 wide; 1 | wide; 1 cco all in good order, nearly complete, Also, rap ropes. RESIGNATION AND DISSOLUTION. Lonpon, March 1. The Press states that the Cabinet council, held yesterday evening, was occupied solely with the discussion of the expediency of resigning. It was argued that the small- ness of the majority was due to the action of the Parnellites ; that it would be pos- sible and easy to continue the government with the present House of Commons, and that it was needless to resign. There seems little doubt that the Cabinet council has decided upon dissolving Parliament, soon after the passage of the Redistribution Bill, DEEPER IN THE MIRE, At the Carlton and other Tory clubs, last night, the politicians expressed themselves as satisfied with this decision,on the ground that during the month’s that will elapse between now and election, the government is sure to get deeper in the mire.
