She had gone to the door between a quarter to and ten minutes to one. She saw a dark coloured closed car go past. A man was driving. and beside him in the front seat on thc right hand side she saw some- thing that looked like a bundle. or a heap of something black. just what she didn't notice. wearing a gray, or light colored cap, she thought. - She then put on her coat and went to the comer. on hearing frofh some one that there had been an accident. There was nothing there at the time but some blood on th street. Exam- ined by Mr. Campbell deposed that at 12.45 on the day of the acicident she was going" home from Church going west on the north side of Euston street. She crossed over to the west‘ side of Spring Park Road, along which she proceeded north. When opposite Mr. Gay's store. she heard a report. On looking round, she saw a car coming north on the street. 1t took a swerve ofi’ Spring Park Road up onto the east side- walk at Mr. Henneseys "It was up on the sidewalk at the time I first 89W 1t." said the witness. "Tilen it swerved again over to the west side and passed close to me. 1 llotlcllll thatt he left front tire was fiat. I do not know much about the makes 0f Cal's. but would say it was a Ford. It was a closed car; I didn't notice how many doors, I noticed the man at the wheel; he had on a gray coat and a gray cap. I couldn't say anything as to his age. The car continued along Spring Park Road and turned to the west at Highland Avenue. It kept close to the west. or left hand side oi’ the road. I did not notice the number. but was under the im- pression that it was not an Island number. I couldn't say how many miles an hour the car was making, but would say it was going pretty fast. Cross examined by Mr. Stewart, the witness stated that, when slle last saw the car, it had turned to the West on Highland Avenue tow- ards North River road. His Lordship, after cautioning the jurors not to discuss the case with any one wllo was not a jury- man, Mr. Stewart submitted that the Jury might well have a view of the scene of the accident. Mr. Saunders concurred. saying that it was what he was about to suggest himself. The car then seemed to be in good com dition. Clinton apeared to witness to be drunk. He seemed to be sleepy. his head was nodding. Witness did condition. He next saw MacKinnon at 1.30 p. m. in Acorn's Taxi driven by Fred- die Walsh. Their car was in the gar- age then. It had a flat tire on the left front wheel. The right rear wheel had a rim on it, but no tire. ‘Later, witness noticed that the spok- les in that wheel had fresh cracks in them-they seemed to have been badly strained. There was a man, partly in the i uck seat, partly in the front seat, ipartly on the floor. The man didn't |move or speak. He was Clinton. Wit- fnesses man, Livingston, began to l-work on the car. He took ofl’ thc right rear rim and put on a spare ‘tire. He started to attend to the (left front wheel, but was ordered to stop by witness after Constable Big- gar had spoken to him. As Clinton lay in the car, his feet were in the front seat and his head in the back. The man appeared to be asleep or drunk. He was taken away by Of- flcer Bigger. Witness thought he was drunk. Asked as to clothes worn by Mac- lKinnon, witness said he didn't not- ice. Nor did he notice llis cup, nor ‘the clothes and cap worn by Clin- ton. Witness next went ‘on to describe the cur, which he said was u. Ford sedan of all old model. bearing a Michigan number plate. Shown a number plate by Counsel. witness said "It might have been the one." The car contained two seats in front and one in the rear. doors. He believed there was one other car like it in the city, and one owned outside. of the same model, but not thc same colour, this other car being painted green. Cross examined by Mr. Johnston witness said "l wouldn't say just when they came there. At. that time Clinton was alone in the car; Mac- Klnnon was not there.
