Ltd. the said Edmund J. Perry well knowing the same to be stolen. In the second case on the docket Joseph Cyril DesR.oche.s of Mis- couche was charged with having received from Henry J. Gallant Uh. sum of 5.50.00 on terms requiring him to pay the same over to John K. Curran, did unlawfully and fraudently convert the same to his own use and thereby steal said sum of 550.00 The property of John K. Curran. The charge arose from the sale. by the accused. of four calves be- longing to Mr. Curran. last Feb- ruary, for which he received a cheque of 850.00 from Henry J. Gal- lant, cattle buyer of Wellington. At the time of the transaction Des- Roches was employed as head farmer at Mr. Curra.n's St. Eleanors farm. Contradictory evidence was heard as to whether Mr. Desnoches was ever given authority to sell the cattle. The records of buyer. Henry Gallant, showed he had made five different purchases of cows and calves from the Curran farm since October, 1953. Witnesses appearing for the crown were J. K. Curran, Henry J. Gallant, and Joseph Earl Des- Roches, brother of the accused. who was also employed on the Curran farm at the time the sale was made. Mr. D .0. Stewart, Q.C., repre- sented the crown. Mr. H. 1''.
