Judgment was rendered Thursday by His Hon- or, who decided in favor of the de- fendant, dismissing the case. The charge was assault and battery, the plaintiff claiming that Peter Gum- miskey had hit him with the hoe cut- ting two of his lingers. The plea of the, defendant was self defence, who contended that McKenna first threat- ened him with a stone, and that he used the handle of the hoe in self defence.
