Thorne’s house. When I came along first I saw Wm. Proud, Peter Proud, (ilorge Rodd and James Carr driving in ai wagon. They stopped opposite Thorne’e, and Wm. Proud and uarr got out and went as if to Carr’s house. 1 saw Rodd and Peter Proud sparring in the wagon just oil' the sidewalk. John Trainor and John Hughes came out of Thorne‘s house, and were going for a drive. They were going to take Proud`s horse. They got into the carriage and Proud said, ‘- Hold on and 1’ll go with you.” They then drove about 50 yards down the road and then turned back again. Proud was driving coming back. They stopped in front of 'l`norne’s again. They got out of the carriage without any words. George Rodd had awhip in his hand and was standing by the waggon. Then Geo. Thorne took it out of Rodd’s hand and put it in its socket. He told the boys to go away from the waggou and told Peter Proud to drive on. Proud and Traiuor had some words when Trainoi' was getting out of the waggon. Trainor then stood back from the waggou. Peter Proud saw his bro- ther Vlfilliam coming along and~ he jumped our to tight Traiuor. They began to light. Thorne and Hughes were standing around but look no part until Wm. Proud went to run in at Trainor to help his brotlier. 'I‘hen Geo. 'l'horne hit Wm. about the neck or the )a.w. The blow seemed to have no edect, for Wm. Proud turned around and ran away. Peter Proud then get into his waggon. Some fellow was hit- ting William iu the gutter. It was Geo. Thorne. He hit him twice in the neck and made two kicks at him. Then Wm. got into his waggon. Before he got into the waggon the carriage went over him. George Rodd got in too. They drove down towards Uiirr’s. Theycame back ent towards Thorn . He drew to hit Thorne and wanted to know who hit him. John Trainor and Peter Proud at this time were into afight in the giingway and while they were fighting Wm Proud was out in front of the house with his back against the house. He was pretty drunk. Four or live were around him all trvinz to get a crack at mm Two of them were lhorne and Edward Hughes He walk ed over towards the waggon and when half way in he fell on the seat His eve was swollen up and his mouth all bleed ing He never uttered a word and his head soon dro i \ pp o one struck him from *he tiii.e he left the house and got into the waggoii John Proud (sworn) I am a first cousin ot the deceased I was in town the day my cousin was killed I _,aw the last of the iight When going home I saw a crowd assembled right opposite lhorne’s 'W hen I got there the de ceased was laid in the waggou to all appearances dead I did not see any ot the striking At th s time John Trainor and Peter Proud were fighting on the street Peter was going to 31515; his brother who was in the waggon when Trainer went up and hit him on the mouth I then went up and interfered l`her. George Thorne, Ldward Hughes, and John Hughes came along and took l`raiiior away Dr Harry Johnston (sworn) I made an examinationo the body and found that the face was somewhat bruised and tnere was a cut on the nose which had been bleeding On his lower lip there was a cut There was a small bruise on the right side o his neck The front or his neck was very prominent lt was either swollen or displaced forward There were no marks or bruises on his arms or body Us perfoimiufr the 03; o P moricni we found that tae different organs ofthe body were in a normal, condition We found a fraciure of the larynx or windpipe in the second ring The right heart was full of blood and the left s'da was empty The lungs were somewhat collapsed The brain was rather more lull ol blood than one would expect I`akin<' the fracture ol the windpipe and the condition ot the other organs, it would conclusively prove that the cause of death was a blow dealt in the vicinity of the windpipe Phe simple fracture of the windpipe in the condi _ yi sn behalt ot himself, each one made the same reply " Not Guilty. ” .
