The Supreme Court opened this morning at eleven o'clock, the three Judges being g present. The hearing of an application for a writ of certiorari to remove a conviction made by the Stipendiary Magistrate of Charlottetown against John Joy fora breach of the Scott Act, was the first case called on. There are | several grounds for the writ, the principal being that the Magistrate directed the City Marshall to bring the prosecution, and that |on that ground, as well as because the fines are paid “inte » the city funds, out of which the Stipendiary receives his salary, he was | disqualified by reason of interest from trying the case. There are seven similar applications by dif- ferent defendants. Mr. Arthur Peters appeared for the appli- cants, and Mr. Davies, Q. C., for the city. LETTERS TO THE EBITOR. oe Carrying it Yoo Far. Srr,—There can be but one feeling amongst all discreet and sober-mindee per- sons in the community as to some of the remarks in the editorial of the last Protes- tant Union, respecting our worthy Stipen- diary Magistrate. The press has, doubt- less, a right to insist upon public officers performing their duty; but in the exercise of that right the public have also a right to expect that the amenities of social life shall be sacredly observed, especially when the writer is under the protection of the holy office. It was expected that when the Protestant Union passed under the manage- ment of its present editor the sts andard « taste and propriety - a has beer in avery apprec table proportion but this almost weekly dogging of Mr. Fitzgerald is beyond justiication.
