I probably did not do it as I should» have, but the idea I had in mind was that I was going to credit these items back after the Dominion Audit was made and the Government would get the full benefit of the return instead of cred- iting it back. Q. You are aware ,nq doubt, that a. complete record should have been kept inasmuch as you were handling public monies and t... equently were accountable therefor? A. Certainly. I am not excusing myself at all, but I didn't think of it. I frankly admit that possibly I was careless in it. .Q. Was there any special or par- ticular reason why you thought or considered it better not to have kept a record of such receipts? A. No. I did keep a record in this way until I deposited the money. If I took anything oiI for expenses I had a record that it was done and I did not think it necessary afterwards. I just kept a memoranda of it. I have not benefltted in any personally, and it is most diflicult for me to go back over a number of years and say things accurately. I have no intention in anyway whatever of benefitting personally out of any Government funds; and while my actions may be interpreted other than I intended, (I do not want to say that anyone was unfair to me) it is hard when a man docs a thing that is not entirely understood to be properly inetrpreted. Q.‘ You kept no cash book, Just I. temporary memoranda. There was no ledger account of these items? ‘A. A certain portion of them would be impossible. If a man came in and borrowed some cement, he would return it and 1 would simply make a note of it. If 1t was not re- turned I would bill him tor it. Per- haps there would be a few loads of gravel borrowed and returned. Q. Do we understand that you kept no cash book record of the cash received and also of these sales or loans? ' A. I just kept a mcmoranda. Q. Did you preserve this memor- ands? A. Not of the older years. I think I have them for the last two years. Q- What explanation have you of selling cement to Patterson Walker within the last fewyears? A. I have no record or recollection |or any cement being sold to Patter- son Walker. i Q. Did you consider that you were ipersonally responsible for all such 1 cash receipts? ' A. Yes, I suppose I do. i Q. The Highway Improvement ‘Bank Account was kept at the Bank of Montreal, Charlottetown, was it not? A. Yes. Q. According to my information this Bank Account was opened in i920 and finally closed out in 1929? A. Yes. , Q. I have here s list prepared by l the Bank of Montreal showing all de- ‘ posits made to the credit of Highway Improvement Account from the time it was opened until it was closed. The first deposit was in February, 192i, and the last in February, 1929. Prior to February i921, however, I under- stand ansngements had been made with the Bank to draw cheques against the Account, the total of such cheques having been carried by the Bank as an overdraft, subicct to interest. Is that correct? A. The Highway Improvement was “"9116 by bond or automobile rec- eipts. At the end of the year what- ever was left over from automobile receipts was turned in to the credit of the Highway Account. as a rule. Q. In respect to receipts for sales of cement, cemen bags, gravel and refunds of various kinds, did all gueh I ? Did you make it a point to de- posit all such receipts in the Bank? A. ‘Exclusive of items paid out for cleaning bags, freight, etc. These receipts might not be deposited im- mediately. They might be held on hand for some time. Q. There are several deposits which went to the credit of the Highway Improvement Account at the Bank of Montreal the nature of which I have so far been unable to trace. They are as follows: September 20, 1922 4050 29, 1922 22.25 29, 1922 16, 1922 16,1922 30, 1024 .. . I will tulle a list of them and see if I can trace them out. In the meantime 1 have no recollection of them. Q. There are various items on cle- l 90bit slips dated March 14, 1925; May i 28, 1928 and July 30, 1027, the nature of which I would like you to explain if possible. A. They might be cheques I had on hand perhaps cashed out of Gor- ernment funds. 5o long as I made my ' deposits up to the amount I calcula- ted I owed I felt I was in order. Sometimes people came in and wanted cheques cashed and if we had money on hand I accommodatsd them and quite frequently I made advances in cash to men working. l, Q. All this causes confusion which goes to show that you should noti really have cash on hand? A. Yes. As I stated before. Q. According to a statement received by the Premier from Canada Cement Company Limited, various I cheques were sent to your Depart- ment, begiunlng in 1921 and con- tinuing through the several years up to i929 amounting in all to $12,118.91, apparently in payment of empty cement bags which had been return- ed to the Company. Does this figure seem to you to be about correct? A. 8o far as I know. All these items have been paid in accordance with what I previously stated. Q. Was cement purchased from other concerns as well? A. There was some purchased from Brace. McKay and Company I think in 192i and I think an amount from Poole and Thompson, also later on there was some bought from the Lehigh Valley Company. I think from the time we started to purchase from Canada C ‘ Company there was none purchased from other Compan ies with the exception of the behigh Valley Co, except in cases where small quantities were required quick- ly it was bought from local dealers. Three o'clock p. m. Q. Returning again to the state- ment of the Canada Cement Com- pany, Limited I Iind you apparently received a cheque from them dated December 5th, 192i, for $1,774.00 which was deposited in the uBank on February 4th, I922. This was the first of such cheques and was properly dealt with, it would appear; but I find no record of the * cheque dated April 21st, 1922 for 8264.20 having been deposited, and the same is true of a cheque for 82,545.00 dated March 5th, 1933 ,and another for $131.80 dated June 14th, 1923. The total of these three cheques ls $2,941.60. Can you explain how they were dealt with in your accounts. A. Regarding the cheque for $264.20 from Canada Cement Com- iiany, I iind from the record that I paid $112.17 of expenses out of that Whoa ' lug, cr tying words 1¢._ . of the side.
