It was an application of the defendant in thie suit to be discharged from jail. It appears that the defendant wes committed to Queen’s County jail ueder an execu- tion iseued out of the County Court of Prince County. The iaw re- quires that the Clerk of a County Court can only issue an execuiien against the body ef a defendant when ao allidavit is made showing facts and circumstauces that a defendant is about to depart in order to defraud his creditors. The affilavit in this case only stated that the plaintiff had been informed by a perzon and believed that the defendant was sbsut to leave P. B. I. to defraud hm The court unan‘mousiy held that this effidavit did not satisfy the law, Objection was taken to the jurisdiction of the Supreme Court to grant relief. The Court however held that it had jurisdic- tiou overall infericr courts, and could in- terfere in the prevent case. The defendant was released from jail, Stewart, Q. ©. for the applicant, and Morson, © C. for the creditor. —The Government of>New Brunswick has been reconstructed, Mr. Emmerson taking with the Premiership the oitice of Attorney Genera], and Mr. White (‘ate At» torney General) becoming Chief Commis. sioner of Public Works, while Mr. H.
