penalties arc for a iirst offence 8l00 or
three months imprisonment; for a second
offence $21!) or four months and for a
third and every subsequent offence six
months imprisonment without the option
of a line.
intoxicating liquor is defined by the
Act "to include all spirltuous and malt
liquors and all combinations of liquors
and drinks and dliukahle liquors which
11re intoxicating." By an amendment to
the Act all liquors or liquids or malt beer
containing over 3 per cent of alcohol is
declared to be intoxicating.
Provision is made for the appointment
of vendors, who may sell to legally quali-
tled physicians, chemists or druggists for
medicinal purposes only, or may sell for
exclusively sacramental purposes on the
certificate ofa clergyman affirming that
the wine is required for sacramental pur-
poses.
Druggists are not prohibited from
selling “drugs or medicines mixed with
nlcoholor spirltuous liquors for purely
medicinal purposes." But the sale of

and that the liquor is to be used only for
the particular purpose set forth in tio
affirmation ofthe applicant.
Physicians are permitted to supply
spirltuous liquors to their patients in
the regular line of their practice in
quantities not exceeding at any one
time twelve ounces, but must keep a
reglsterofall such salcsopen to the ln-
specticn of the Government inspector.
All vendors, drugglsts and physicians
are required to keep a register ofall
and any solos made by t.hem\undcr
the Actand to produce when required
tothe Inspector any prescription. earth
flcate or register, undcr penalty for
neglector refusal, of twenty dollars for
a first offence and forty dollars for a
second or any subsequent offence.
But no Inspector is permitted to
divulge any information obtained by hi
inspection of such certificate, prescrip-
tion orreirister, except on any prosecu~
tion under the Act, and if he does so he
is liable to a penalty of ilfty dollars.
And all Inspectors are sworn to secrecy,
unless in case of prosecution.
Provision is music for search warrants
to search for liquors when information is
laid on oath suiilclent to satisfy the
Magistrate that there is reasonable
ground for belief that liquor is being sold
or keptiorsale contruryto law, and for
thc seizure anti confiscation of such
liquors and the prosecution of the
offender.
The giving away of liquors, or any
devicesto evade the provisions of the
Prohibition Act is declared an unlawful
selling.
Apenalty of $100 or three months lm-
prisonment isprovlded against any
person who interferes with an officer in
discharge oi his duties under the Act.
All fines and penalties recovered under
the Act are paid into the provincial
treasury, hut for offences committed in
Charlottetown one tl1l1~d of the fines is
paid to the City Treasurer.
Dr. Percy McLeod of notoriety in
connection with the suit case abortion
and who was acquitted by the court has
been fuund guilty of unprofessional con-
duct hy the Massacllusstts Medical
Society. The decision is subject to
appeal. The penalty is expulsion.
