SINESS TRANSACTED AT LAST NIGHT'S MEETING, Tue regular monthly meeting of the City Council was held last evening. In ice through illness of Mayor Hav- iland, Councillor Beer presided. All the other members of the Beard were in their place 5. ; A letter was read from Benj. Davies, calling the attention of the Board to the large quantity of kerosene oil stored ov aad about the wharves, and suggesting its re- moval outside the city limits, as in the event of fire in the neighborhood,the conse- quences would be disastrous. Referred to the Fire Committee. The memorial, of Albert Allen, asking for the exclusive privilege of posting bills in the city, was laid on the table. The memorial was signed by anumber of bus- iness men A petition from certain residents of Bishop Street, asking that an electric light be placed on the Malpeque Road at the the street, was referred to the Street end of Committee. A letter from John A. Gnriftith informed the Board that there was a fireman's hat, belt and alarm bell on his premises, which should be removed atonce otherwise stor- age at the rate of $2 per month would be charged. Laid on the table. The letter of W. E. Dawson,in reference to the injuries sustained by his daughter in September last, caused by a defective side- walk on Upper Prince Street, and a bill of $260 which accompanied the same, was re- ferred to the Finance Committee. On motion of Couneillor Crabbe it was de- decided to call for tenders for the purchase of the steam fire engine Rollo. received for Queen's Wharf There was one tender for repairing the building and three for dredging the dock. He did not consider the tenders large enough to accept, and thought that under the circumstances it would not be aivisable to make them public. Councillor Hogan explained that the dredg- ing of the east side of the dock would cost between $15 0 and $1600 and the repsiring of the building on the wharf about $300. After this expenditure was made something like $200 more rent could be obtained for the wharf than could be got for it in ita present con- dition, Alter some further discussion it was decided to talk over the matter at an informal meet- ing after adjournment. This was done, as it was thought advisable to let the matter stand over until later on. The matter of the collection of mortuary statistics was again discussed, and Dr. Johue son's bill of $t47 for work performed las* year was laid on the table until next meeting. Horne vs. the Assignees of F. T. New- bery andjihe Bank ot Nova Scotia—an in- terpleader issue. In this case, Mr, Justiie Hodgson delivir-d one of the most elabor- ate and carefully prepared judgments ever given in the court. It will be remem- bered that Mr. Newbery, becoming tinan- cially embarrassed, made an assignment of all his goods and property for the benefit of his creditors, several of whom were pre- ferred. For an overdue balance at the Bauk of Nova Scotia, he had previously given his notes of hand and ‘ warehcure receipts” for certain goods in Small’s warehouse. .Mr. Horne was a creditor of Mr. Newbery. He declined to accept the settlement of the As- signees and sued Newbery, obtaining judgment by confession and a writ of exe- cution. It was held by the Judge that the warehouse receipts to the Bank were given to cover an antecedent debt and, therefore, under the statute, in cfiicacious and value- less, though Small and the assignees were unaware of this fact. Therefore, the pro- perty reverted first to Newbery, and then to his assignees. The decision hinged upon the question whether or not the assignees had come into actual posses- sion of the goods, If they had not ubtain- ed possession, Horne had a -_ to levy upon them as the goods of Newbery; if they had obtained possession, then the levy upon the last day of sale was illegal and wrong. The Judge reviewed at length the facts and circumstances under which the assignees obtained the goods, and decided that they had properly come into actual possession. The rule for a new trial was discharged and the question of costs reeerv- ed. Ou motion, Mr. Andrew L. Brown, of Margate, was this afternoon admitted asa law student in the office of A. A.
