This morning about two o'clock the posse, whose names we have just mentioned, visited Fred’s house for the express purpose of capturing him. Two of their number were stationed ot the front of the house and two atthe rear. One of those in the rear went inside the stable and began rapping on the walls, thinking that when Fred heard the noise he would suppose the horse had broken loose and come out to tie hin” 7 again. The scheme was a good one, but failed to con- nect, Fred heing ‘too old a_ bird to be caught by such chaff.”. He heard the noise, but at once suspected it was’a scheme of the police to entrap him, The hammer- ing continued. Fred told his wife she had better go out and see what was the matter. He noiselessly unlocked the door and let her out, only to be immediately confronted by the policemen. They demanded Fred. She said Fred was not in the house. The officers said he was inside, and if she would not let them in? quietly — they would break in the door. She was still obdurate, While all this payleyjng was going on outside, Fred was inside’ listening to the arguing, and debating within himself whether or not he should give himself up to the police. He went to the front window and looking out, saw that that portion of the premises was as well guarded as the rear. He was on tke point of surrender- ing himself when he thoughi of the cellar, Attired only in pants, socks and shirt, and shivering with cold, he descended to the cellar, crawled in through a small hole in the partition into the adjoining cellar and got up through the hatchway. He _ heard the policemen break in his doors, and in a body go marching through the house, Jook- ing under the beds; aud also breakisy in the door of his bar to see if he was there, but of course failing to find him. At length the cellar was thought of. Officer Bradley went down and began searching among the coals, but of caurse could not get a glimpse of Fred, After considerable searching he saw the small hole through which the fugi- tive had crawled, and at once suspected the truth. Pulling down a portion of the board partition, and calling out to his fel- low ofticers that Fred-had escaped into the other house, he started for the hatchway. The house was again surrounded tg prevent an escape. With hoth front and rear doors guarded, and Bradley coming up the hatch- way, things looked decidedly gloomy for Fred. He went to the front door with the object of unlocking it and making a hold dash for liberty, but on trying to turn the key found theré was considerable difficulty about the operation—that it could not be done without the officers outside knowing it. He next went to the front window and tried it. He found that it would rise easily, and giving it a quick shove up, darted out past the officers like a shot from acanron. A shout was at once raised, aad the chase began. Fred flew along the frost-cavered’ sidewalks like a deer. The pursuers ‘were at his heels shouting as though they were hunting down a murderer. But Fred sped on. When turning Riley’s corner he noticed that the entire posse were close behind him. Chief Justice Ritchie and Strong read their reasons for judgment, and held that the ferry contract voided Perry’s seat in the Loca) House, and therefore he was eligible to the House of Commons. They did not touch on the resignation question at all. Henry and Furrier concurred with the Chief Justice and Strong. Judge Tasachereau dissented, and was oi opinion that the appeal should be allowed, and the seat awarded to Hackett, holding that no right to resign existed, and that the ferry contract dié¢ not vacate the seat in the Local House.
