Ar the Police Court this forenoon, His Honor Stipendiary Magistrate Fitzgerald made the following remarks in re the Slate Case : _ I cannot but observe from various contribu- tions to the press that the parties who un- fortunate'y obtained Charles Slate’s release from imprisonment are now desirous ot using the decision ordering his discharge us a basis for untruthful comments on the administration t justice in this corrt, I see no reason for remaining silent under such circumstances, see many for correcting some of these mis- statements, especially as they are made under the color of a judgment of a Judge of e court of superior jurisdietion. — A FAVORABLE IMPRESSION. mes Xp First as to this dicision, I judge from its | terms it does not decide : Ist. That drunkenness is not in the nature | of a crime to be proceeded againet and punished as such. 2nd. That the offence of drunkenness on the public streets is conlined to cases in which the police actua!ly make the arrest. 3rd. That Charles Slate was illegally de- tained by the police on # charge ot drunken ness immediately after the period of his arrest as a wituess bad expired 4*h. That when a person is actually under arrest and before a iwagistrate there is any necessity for either information, summons or Warrant 5th, That to remand a prisoner owing to the absence of testimony is illegal. 6ch. That the Criminal Procedare Act does not give to the Magistrate the discretion as to when and how often he should remand prison. ers charged before him, Second— As to the comments on this de- cision : Ist. 1 desire it to be understood that no man is ever arrested by the po.ice for any offence without a sworn information and war- rant, except when the criminal ia caught in flagrante deticto. 2nd. That the practice of this court is to allow anyone, including the police, to make a charge agaiost a person then actually in custody for ano‘her offence without inform. ation, summons or warrant, and to hear and determine such charge when prosecutor and prisoner are both ready for trial, which prac- tice 1 believe is in accordance with the law. 8rd. That necessarily chronic inebriates sud habitual criminals are treated differently from mere Casual offenders, and in exercising my discretion as to :emands, one class I cou- stently remand, the other never, exc>pt whea absolutely necessary, 4th. That Charles Slate for the past eight years has been treated by me with @ personal kindness, which I[ do not think he will be slow to acknowledge; though sometimes such kindnesses have taken the shape of remands. This is all I deem it necessary to say to avoid a misconception of the practice of this Court, except that I regret to see that a por- tion of the press is being used by those whose evident desire isj to thwart the due adminis tration of justice. ———_— <0 For Over Fifty Years An OLp axon We tt-Triep Rewepy,—Mrs, Wins!ow’s Soothing Syrup has been used for over fifty years by millions of mothers for their children while teething, with perfect success.
