The'decision was unanimous. ‘Thereby a source of in- come of approximately $25,000,000 annually was assured to the govern- ment. Of all the objections to the tax raised by suits in all parts of the wuntry, none of them was found suf- ficient to nulliiy the law, The court did hold that the tax was not applicable to the real estat: trusts of Boston, which are organiz- ed not under any statute, but under the common law. The law was held not aDp1icable to the Minneapolis syndicate, a real estate concern, on the ground that it was not doing business within the meaning of the law. ’l‘he fight against the constitution- ality of the corporation tax began almost immediately after the enact ment oi th`c Payne-Aldrich tarifl law of 1909, of which it is a part.
