In Callie Case Three men. charged with cattle stealing at St. Peter's. were sent to the Supreme Court for trial as their preliminary hearing concluded at Georgetown yesterday. They are George Macxay and his brothcr. Charles MacKay of Gagetown. NE. and Bernard Christensen cf Bass River, N.S. The hearing was before stipend- lary Magistrate Joseph W. Mac- Donald and had been in progress since last week. The men were arrested at St. Peter's by R. C. M. P. on the morn- inb of Dec. 8 and charged with the theft of five calves from Ches- ter C. Pratt, St. Peters. valued at 3300. only evidence yesterday was cross examination by the Crown of Charles MacKay. who had com- pleted his direct examination when the hearing adjourned on Friday. He was the last of the three accus- ed to give evidence. Under cross examination he told of leaving Sturgeon. P.E. I. at about 6.30 p. m. on Dec. '7 for BI'llfi- cnell. dropping off Christensen at Montague. The witness said he ;hen proceeded to pick up cattle winch were purchased, and Christ.- rnsen did the same. when they arrived at St. Pot.-r's ahey left Chrlstenscn's truck at the- stock pen. with six calves on it, they then proceeded to Souris where they unloaded cattle on the witncss' truck. He told 0 Mr. Pratt getting five calves he identified as his from the car. The -witness said the car should have contained 26 sheep when shipped but the railway count at Moncton indicated only 23. He contended that on the facts of the casn the Magistrate would be just- ified in discharging the three ac- cuscd. He said that it was unusual in cases of prelimlnaiy hearing for the accused to take the stand and also that the crown had no right to cross examination in a. prelimin- ary inquiry. Hp reviewed the evidence and contended that no guilt existed and that it was a perfectly proper case for dismissal under the criminal Code. Mr. 5.3. Hessian. K.C.. crown prosecutor fur King's County. said that the defence had asked for tho prelirnlnery"'lnqulry- end that the Crown did not deny them any rights from the time of the arrest to the present. Many of the con- tentions of Mr. Methleson were quite true. he said. if Mr. Methio- son had allowed the Magistrate to sit on the case as I summery trial But this was not e summery trial but a preliminary inquiry. The verdict guilty or not guilty should be left to the Ocurt the defence asked for. and he asked that the usual procedure he followed and the men put on their trial. Stewart United Church to capacity -to enjoy a very fine Choral Ser- vice put on by the Young People's Union of St. Johns Church. Two young people did the usher- ing. Two received the offering and we read portions of scripture relating iihe Christmas stories through which were introduced the different chorals. Twenty-two young people were in the choir. The service opened with a pro- ocssional -hymn followed by the use of the Beatitudes of our Lord as a -prayer. Each Bcatltude was re- sponded to with "Grant us this grace. we beseech Thce, O Lord.” This was followed by the Lord's Prayer in unison.
