The getting of a new iip-t0- date plant would give the citizens far more satisfaction than to buy a second-hand plant; part of which was older than the oldest man in that room, and very little of which was good, up-to-date or new. Mclilacherni agcs against the city of Charlotte-I town for injuries sustained by our clicnt at the crossing on the west' side of Rocliford street at the corner of Mr. Kcmp's property. It seeuis that thc city has recently construct- ed n. coiicrctd sidewalk along the western side of Ilocliford street, and at the crossing at Mr. Komp's cor- ner, the sidewalk has been so cou- structcd that people passing along the struct are liable to sustain very serious injuries. As our client was going along the street recently her .foot got. twisted in the gully or ws- 'ter course constructed at Mr. Kemp’s corner, and as the result, clearly liable for the damages sus a case of non- feasance on the part of the Corporation; it is a case of mis-feasance owing to the improper construction of the sidewalk by the corporation, which renders it liable for damages. We would therefore ro- quost that a settlement of this claim be made forthwith, and if Your Wor- ship and the City Council decide to contest the intended action, will you kindly let us have the name of an attorney who is authorized to ac- cept service of a writ on behalf of; the corporation?" - On the motion of Councillor Riley seconded by Councillor McNevin, it was decided that the matter should ie referred to the Recorder for re- port to the Council on it. , A COMPLAINT.
