Firrn Day, Monday, July 13. Rowan Firzceratp, sworn—examined by Mr. C. Palmer : I am a law-student in the office of Mr. Hodgson, the plaintiff. Have been 4 yeare in his office. Never heard what passed on matters of business. The conversation on such subjects was conducted in low tones. No student was expected to hear it. Onee, when old Mr. Dawson came into the office, I heard him ask the bookkeeper for a list of notes. I understood him to mean a list uf the notes which had been lett by his son, W. B. Dawson. He said he wanted to have a memorandum of the notes he had endorsed. He came in two or three times for it. Ht was made out. The impression upon mind is that he got it. There was no objection made to giving it to him. I think it was about two years ago this summer. The reason he gave for wanting it was that he wished to know how many notes he had en- dorsed. Cross-examined by Mr. Thompson : W. 3. Dawson often came into the office. Never saw him endorse a note. Never saw him write upon one * waiving presentation, demand, and nvtice.”’ Can’t swear that [ have never seen him endorse; but I don't recollect that I ever saw him do so. I think that when W. B. Dawson brought batches of notes, he signed something at Mr. Bellin’s | (the bookeeper’s) desk. Don’t recullcet that Mr. Hodgson was present at such times.
